Tho Constitutionalist, of Tuesday, says: -
Mr. K. II. Pughe, yesterday, executed the
l>onds required by tho decision of Judge Gib
son, when the injunction on the Doily Press
establishment was withdrawn, and the mate
rial turned over to the use of Mr. Pughe, who
advertises a resumption of business.
The Columbus Sun says that the fall of rain
about that city and the surrounding country
for miles around, since tho first of August, has
not been sufficient to enable the people to put
iu their turnip crops. If copious rains do no-
descend shortly, tho potato crop will be all
most a failure, and the turnip crop a totnt
failure.
The Journal and Messenger says that not
one of the magistrates oi Macon has made his

of view, w hile constables saunter lazily up and
down the streets, with nothing to do but to

Read. -Professor M. C. Read, of Hudson,
Ohio, with tho geological corps of Professor
Newbury, now developing the mineral rc-
HQurccH of Warren, Ohio, passed through re
cently and reported the fiudiug of lossils of
tho fish vuriety, in the shale rock beneath low
water in tho Mahoning river, obout oue-balf
mile north of this point. Among tho fossils
found was that of n fish's spine, measuring
fourteen inches, which belonged to one of tho
finny tribe supposed to be about fifteen or
sixteen fcot iu length. Professor Head also
reports that the stone known as the Berea
sandstone lies beneath Warren, ami is ac
cessible and suitable for digging.

of the Reconstruction Acts, a condition pre
cedent to the restoration of the Htato to Us
constitutional rights in the Uuion. After
which ratification, according to the recent de
cision of Attorney General Ho«r. in the Vir
ginia out*, the Legislature could go no further
nutil this action of tbelra should be approved
by Cougres*. The enforcement of this Aux ud-
went, therefore, (as ratified) became a Mine
qua non to the full recognition of the Htutc
government by Congresses "republican iu
form," and tln-uoo the admission of our Dona
tors aud Representative* to seats iu the na
tional Legislature.
Hence to have ratified, iu ft formal nmnmr,
the Fourteenth Amendment was not enough;
the provisions of that Amendment must be
enforced. Thu is u necessity, without which
all future or further action as expodienis arc
unavailing.
In other words, under tho present .state of
affairs, it is uot euough to restore the colored
members to their heats iu the General Assem
bly; although this, iu the very uuturo of
things, is a comlitiou precedent to all efforts
at adjustment; hut this action must be follow
ed up by an honest and bona Jnlt inforceunut,
by that body, of tho provisions of tho Fourteenth
Amendment. That is, the colored members
should bo restored to their seats, because, un
der the interpretation of the State Constitu
tion by the Supremo Court, they are legally
emit led to their places; and the Legislature
should be purged of all such members as are
obnoxious to tho Amendment, if indeed there
be any such members.
Thus tho ratification of the Fifteenth Amend
ment becomes a mere side issue, uot in it
self essential to tho full reconstruction of
Georgia, though it is so with respect to Vir
ginia and Mississippi. As a Republican meas
ure, however, and one which is right in itself,
it is noped tho Legislature will promptly rat
ify that also. It should be ratified because
the same rights and privileges claimed lor ool-
ored citizens in Georgia, should be extended
to all and to each of tho other States of the
Union. Even “Democrats” will admit that if
it be right for negroes to vote and hold office
iu Georgia, it is no loss right and proper iu
the Northern States. Failure, opon the part
of our State Legislature, to ooinply with these
plain provisions of the Reconstruction Acts,
aud with the letter and spirit of the new Con
stitution, which Congress accepted
earnest of “a Republican form” of Govern
ment in Georgia, may result in disastrous eon
sequences to tho Stato. That it will provoke
additional Legislation by Congress, to tho end
that tho State shall be reconstructed in strict
accordance with the Blau proposed, wo have
uo sort of doubt; aud in such an event, it
will become the duty of every true Itepub
cau and Uuiou man iu Georgia to sustain^ to
tho very letter, this additional action of Con
gress.
Under all the circumstances therefore, i
does seem the lioiglit of madness and folly,
upon tho part of the radical “Democracy," to
keep np this useless controversy with tho
General Government. Moderate Democrats
should, it seems to us, lose uo time in break
ing loose from tho leadership of those oxtre
and impracticable men whose policy can
suit iu nothing short of imposing additional
restrictions upon tho people of the State, and
to tho manifest detriment of every business
and political interest of our people. This
their opportunity, if they will only have the i
gacity to seize upon and improve it. We give
them fair warning, and at tho same time
tend them a cordial welcome to co-operation
in the great work of restoring Peace and Con
fidence to tho Stute.

it was generally understood that no quorum

motion made to expell Judge Whitaker

dodged ell these matters. They were rocks
that threatened a split, aud those who oerne
here to do something or other, weut back with
as much graoe as did the “Duke of York" from
his celebrated inarch over the bill. Judge
Whitaker neither resigned uor offered to ro-
sign, which fact appears tb establish bin con
stancy and fidelity to the Democratic party.

thinking men of the country. It has sdvaucod
to ils prese nt impregnable position slowly but
surely. We have stood firmly by the Republican
land marks; and now that the demoersoy is
torn nnd shuttered, wo extend to it a kindly
hand, nud say to the sick and wounded of thut
sinking craft, come with us and we will do you

Our doors are wide open to all who come
with pure intentions, and wo would turn none
empty away.
The plan whereby to savo Georgia is to com
ply with all tho requirements of Congress, and
he who dallies longer by the wayside is short
sighted and not wise.
A late letter from Cuba says the Cap
tain General is in constant dread of tha vol
unteers, uud fears they will drive him out and
seize tho Government, and declare the island
independent of Spain. The same authority
says the outrages of the volunteers increase
fearfully, and are of a character too revolting
to be described.

racy. We agree with the Constitution that
the Judge should be expelled; not beoeuse of

have the right to expel the balauoe of the to-
oallod Democratic Eiooutlvo Committee. Lot

Judge Oabaniss, Chairman, an old, dyed In

Nothing and a Union man when the war
broke out, and, we beltevo, voted for Bell,

The Test Oath.
We have opposed the application of the test
oath from the beginning, and the recent de
cision of Mr. Attorney-General Hoar, in tho
case of Virginia, fully sustains our position
from first to last. Tho Eba ban never wanton
ly gone back upoa its record, and never will.
We are pleased to find ourselves snstainod by
so able a Cabinet Minister as the distinguish
ed gentleman alluded to. We contended, and
still contend, that tho exact spirit of tho Four
teenth Amendment can bo proporly carried
oat without the application of the test oath.

and clergymen to attend the approaching
Ecumenical Council in Rome was a mistake.
The Pope’s two letters to Greeks and Protes
tants are published in London; but while they

meeting of the cotton merchants, spinners
and manufacturers, at Manchester last eve
ning for the purpose of considering the c< n

August, ultimo, Dr. Thomas H. Butler aud his wlfa
wero shot at and serlooalj wounded, at their residence
In Spalding county, in this State, by a P*riy or parties
unknown; and that on the night of the 2dth August,
ultimo, John P. Lovett, a oltlaen of Spalding county,
was also shot at and seriously wouuded by sonic per
son or persons unknown, while sitting in the {Kasaa
of his residence In said oounty of paldlng; and
Whereas. It Is alleged, that oueLe *is Travis, a noto
rious outlier, and who Is now an aacaped prisoner from
Hpaldiug county jail, under a charge of felony, is the
perpetrator of these crimes; aud It being represented
to me, that the olvil officers of said oounty of Hpaldiug
have used evary means in their power to appre
hend ths said Lewis Travis, but without avail;
Now, therefore, I have thought proper to Issue this,
my proclamation, hereby offering a reward of One
Thousand Dollars for the apprehension and delivery
of the said Lewis Travis, with evidence sufficient to
oonvlct, to tho Sheriff of said oounty of Hpaidlng.
