alter the 30ih of June, 1804, and used with-
a stamp, it canuot afterwards be effectually
stamped. Any failure upon the part of the
maker ot uu instrument, to appropriately
stamp it, renders him liable to the penalty
of two hundred dollars.
Suits are commenced in rnauy States by
other process than writ, viz: summons,
warrants, publication, petition, &c., in which
cases these, as the original processes, seve
rally require stamps.
Writs ot sriro tacias are subject to stamp
duty as original processes.
The jurat oi an affidavit, taken before a
Justice of the Peace, Notary Public or
other officers duly authorized to take affida
vits, is held lo tie a certificate, aud subject
to a stamp duty ol five cents, except wben
taken in suits or legal proceedings.
Certificates of loau, in which there shall
appear any written or printed evidence ot
an amount of money lo lie paid on demand,
or at a time designated, are subject to a
stamp duty us " promissory notes.
Tne assfgniucui of a mortgage is subject
to the same stump duty us that imposed
upon tlie original instrument; that is to
