The National Tntelligtnter, referring to the first
dny’a proceedings ol llio Fortieth Congress,
says
By formal vote, the rule* of the House were
suspended lor one week. As it the minority are
not sufficiently In the power of the majority, the
latter has virtually declared that there is to be no
parliamentary law but the will of the majority.

thus gets a practical assertion on the very first
day or tho Fortieth Congress. If that spirit is to
mark its deliberations, liow many of that vast
concourse will be enabled to bo called freemon

PROTEST OF PRESIDENT JOHNSON.
In the House on Monday, shortly after the or
ganization of the Fortieth Congress, tho Speaker
announced that tho President had signed tho
army appropriation bill but had done so under a
protest, which was read as follows:
To the Haute of Representations :
The act entitled “an act making appropriation
for the support of tho army for the year ending
June 20,1808, and for other purposes," contains
provisions to which I must call attention. These
provisions are contained in the second section,
which in certain cases deprives the President ol
liis constitutional fuuctions as commander-in-
chief of the army, under the sixth section, deny
ing to States of tho Union the constitutional right
to protect themselves in any emergency by means
of their own militia.
These provisions are out of place in an appro
priation act. I am compelled to defeat the ne
cessary appropriations it I withhold my signa
ture from the bill. Pressed by this-circumstance
I feel constrained to return the bill with my sig
nature, but to accompany it with my protest
against the section which I have indicated.

THE BANKRUPT BILL SIGNED.
The President has signed the bill establishing
a uniform system of bankruptcy. This bill is now
a law, and will take effect at once. The lnlelli-
peiicer thinks tho enactment will be hailed with
great gratification throughout the country, and
especially in those States where arc yet to be
found tho wrecks of the financial disasters of
1857, as well ns those necessarily attending the
late war. It is understood that this law sweeps
away all State insolvent laws and stay laws, and
laws of imprisonment for debt.
THE FLAG OF OUR UNION.
The Washington Republican says there was
once a flag of the Union; but now ten of the
“ pretended States ” have been converted into
five military districts, and it is not an easy matter
to-day to define, the flag which Congress would
recognize as the emblem of our Government.
SOUTHERN RECONSTRUCTION.
"Data,” of the Baltimore Sun, says: Private
information received here gives the assurance
that tho Southern people will at once accept the
situation and select delegates to form a conven
tion, in pursuance of tho military government
bill. A delegation from Virginia have been here
and consulted leading men on the subject. They
also called on the President and made known
their purposes. They learned from Mr. Johnson
that, so far as the administration was concerned,
the law will be executed to the letter.
PROTEST OF THE CONSERVATIVES.
The following is the protest of tho Conserva
tive members of Congress agaiust the organiza
tion on Monday, which the Clerk saw fit to de
cline receiving.
Whereas, it appears by tho record just made
that the following States, seventeen in number,
are not now represented upon the floor ot this
House, viz: The States ol Now Hampshire,
Iiliotlo Island, Connecticut, Virginia, North Caro
lina, South Caroliua, Georgia, Florida, Alabama,
Mississippi, Louisiana, Texas, Tonnessce, Ken
tucky, Culiloruia, and Nebraska—States entitled
by act of Congress of Murch 4,1802, and subse
quent acts, to representation in Congress, os fol
lows: New Hampshire, 3; Rhode Island, 3,
Connecticut, 4; Virginia, 8; North Carolina, 7;
South Carolina, 4; Georgia, 7; Florida, 1; Ala
bama, 0 ; Mississippi, 0; Louisiana, 5 ; Texas, 4 ;
Tennessee, 8; Kentucky, 0; Calitoruio, 3; Ar
kansas, 3 | Nebraska, 1; in all eighty Congres
sional districts, now unrepresented on the floor
of the House;
Aud whereas, of these unrepresented States
seven are of the original thirteen that, in 1787,
met in convention and created the Constitution
of tlie United States—New Hampshire, Rhode
Island, Connecticut, Virginia, North Carolina,
South Carolina aud Georgia—a majority ol-tbe
original; therefore, we, members oi the Fortictli
Congress, do now enter our most solemn protest
against any and every action tending to the or
ganization of the House until the absent States
are more fully represented.
