The following is * full summitry of tlio pro
visions of the Bankrupt bill, which 1ms been
signed by the President and is now a law:
1. The United States District Courts are con
stituted Courts of Bankruptcy; a judgo sitting
In chambers having the same powers as when
sitting In court. Bankruptcy cases may be heard
in any place in each judicial district, on duo no
tice by the court of time and place.
2. Tho United States Circuit Courts are em
powered to exercise general superintendence and
jurisdiction in bankruptcy proceedings, and may
sit as courts of equity.
3. Registers in bankruptcy to bo appointed in
each congressional district, by the district judges,
on the nomination of the Chiei'Justice of the
Supreme Court. No person to lie eligible ns
register unless lie is a counsellor of tho United
States District Court or n court of record in tho
«State in which he resides, llis bond to be not
'i less than $1,000, and the oath taken as prescribed
by the oath act of July 2,1862.
4. The ministers aro empowered to make ad
judications of bankruptcy, to receive the sur
render of any bankrupt, to administer oaths in
all proceedings before him, to hold and preside
at meetings of creditors; to tuko proof of debts,
to make all computations of dividends and all
orders of distribution, and to furnish the assignee
with a certified copy of such ordeis, and of the
schedules of creditors and assets filed in each
case, to audit and pass accounts of assignees, to
grant protection, to pass the last examination of
any bankrupts in cases whenevor the assignee or
a creditor do not opixisc, nnd to sit in chambers
and dispatch there such part of tho administra
tive business of the court and such uncontcsted
matters as shall be defined^^n and
titular manner direct; nnd he shall also make
shot t memoranda ol ids proceedings in eacli ense
in which he shall act, in a docket to be kept by
him for that purpose, and he shall forthwith, as
tlie proceedings are taken, forward to the Clerk
of the District Court a certified copy of said
memoranda, which shall be entered by said clerk
in the proper minute-book to bo kept in his of
fice, and any register of the court may act for any
other register thereof: Provided, however, that
uotliing in this section contained ahull empower
a register to commit for contempt, or to hear a dis-
mted adjudication, or nuy question of the nl-
owance or suspension of an order of discharge ;
but in all matters where an issue ot fact or of
law is raised or contested by any party to the

five days to express in writing Ids acceptance of
tho trust, tho judgo or register may fill the va
cancy. All elections or appointments of assign
ees shall bo subject to tho approval of tho Judge.
Tho judgo may require tho assignee to give bond
to the United States, with a condition for tho
faithful performance and discharge of ids duties.
14. On the appointment of assignee the regis
ter shall convey to him all the estate, real and
personal, of the bankrupt, with deeds, books and
papers, and sucli assignment shall relate back
to the commencement of said proceedings in
bankruptcy, and thereupon tho title to all such
property and estate, both real and personal,
shall vest in said assignee, although the same is
then attached on mesne process as the property
of tho debtor, and shall dissolve any such at
tachment made within lour months next prece
ding tho commencement of said proceedings.
Provided, however, That there shall be excepted
tho necessary household nnd kitchen furniture,
nnd such other article* nnd necessaries of such
bankrupt, as the assignee shall designate nnd set
apart, having reference in tho amount to the
family, condition and circumstnuccs ot tho bank
rupt, but altogether not to exceed in value five
hundred dollars; and also the wearing apparel
of such bankrupt, and that of bis wife nnd chil
dren, and the uniform, arms and equipments of
any person who is or has been a soldier in the
militia, or in the service of the United States;
and such other property as now is, or hereafter
shall be, exempted from attachment, or seizure,
or levy on execution, by the laws of the United
Suites, and sucii other property, not included in
tho foregoing exceptions, as is exempted from
levy and sale upon execution, or other process
or order ol the court, by the laws of the State in
which the bankrupt has his domicil at the time
of the commencement of file proceedings in
bankruptcy, to an amount not exceeding that
allowed by such’State exemption laws in force
in the year 1864. And provided further, That
no mortgage ol anv vessel, or of any ntw rooUs
o, Sir, made as security for any debt or
debts, in good faith, ami for present considera
tions, and otherwise valid, and duly recorded,
pursuant to any statute of the United States, or
of any State, shall be invalidated or affected
hereby; and all the property conveyed by the
bankrupt, in fraud of Ids creditors; all rights in
equity, closes in action, patents and patent
rights and copyrights; all debts due him, or nny
person for his use, ami all liens and securities
therefor; and all his rights of action for property
or estate, real or personal, and for any cause of
notion which the bankrupt hud against any
person, nrising from contract or from the unlaw
ful taking or detention, or of injury to the pro
perty of the banknqt; and ail his rights of
redeeming such property or estate, with the like
proceedings before him, it shall be bis duty to I right, title, power and authority to sell, manage,
cause that question or issue to he stated by the ' dispose of, sue for, and recover or defend the

15. The assignee may sell the real and personal
property for the benefit of the creditors, subject
to the orders of the court.
10. The assignee may sue in his own name to [

33. No debt creuted by tho fraud or embezzle
ment ol tho bankrupt, or by bis defalcation as a
public officer, or while acting in any fiduciary
character, shall bo discharged under this act.
84. A discharge granted under this act, shall
release the bankrupt from all debts, claims, lia
bilities and demands which were or might have
been proved against his estate in bankruptcy,
and may be pleaded by a simple averment that
on tbc uay of its date such discharge wnB granted-
to him setting the same torth in har. verba, as a
full and complete bur to ail suits brought on nny
such debts, claims, liabilities or demands, and
the certificate shall be conclusive evidence in
favor of such bankrupt of the fact nnd regularity,
of such discharge.
85. Preferences and fraudulent conveyances
are declared void.
36. This section provides for the bankruptcy
of partnerships and corporations.
The remaining sections provide for involunta
ry bankruptcy, for superseding bankrupt pro
ceedings by arrangment, for penalties against
bankrupts and officers of the court and for fees
and costs, nud define the meaning of terms and
the computation of time. The law goes into
effect from the date of its approval by the Presi
dent.

6. During proceedings before a register, the

register shall he bound to attend at the place and
time designated, nnd shall be entitled to piotec-

falsely before a register, shall be liable to all the
penalties, punishments nnd consequences of per
jury.
8. Appeals may be taken from the District to
tile Circuit Courts m nil cases in equity, and writ*
of error may be allowed to Circuit Courts from
District Courts when Hie debt or damages claimed
amount to more than $500; and any supposed
creditor, whose claim is wholly or in pnrt reject
ed, or an assignee who is dissatisfied with the al
lowance of a cluirn, may appeal from the deci-
tnn of the District Court to the Circuit Court for
the same district. The appeal shall bo entered
at the term of the Circuit Court which shall be
tirst held within and for I he district next after the
piration of ten days from the time of claim.—
Hut if the appellant in writing waives his appeal
before any decision thereon, proceedings may be
had in the District Court ns if no appeal had
been taken, and no appeal shall be allowed un
less lire appellant at the. lime of claiming the
same shall give bond in manner now required by
law in cases ot such appeals. No writ of error
shall be ulloivcd unless the party claiming it shall
