On the 2fllh instant the muss between Ben
Butler and Bingham of Ohio, was renewed in the
House of Representatives at Washington. The
following is the account of the “ second round
Mr. Butler called the attention of the members
to the (act that Mr. Bingham had revised and a!
tered and materially changed the Globe reporter's
manuscript of the personal debate of last week
between himself (Butte;) and Bingham.
Mr. Butler then laid on the desks of the mem
bers a printed pamphlet shewing the report as —
written and printed. He characterized this pro- :
cecding as most unfair, in defense of his assertion

Booth’s death, and he quoted from the diary
"I have endeavored to cross the Potomac five
limes and foiled; I propose to return to Washing
ton and give myself up and clear mysclt from
this great crime."' He contended that this piece
of evidence would have shown, in his judgment,
that Booth, up to a certain hour, ucaut the eaj
ture and abduction of Lincoln, and he changed
his purpose and resorted to assassination. It
Mrs. Surratt did not know of this change she
would have had no knowledge of the intended
assassination, and therefore could not have been
convicted.
If all the testimony had been presented we
should have been able to pursue the accomplices,
and find ont who it was that changed Booth's
purpose from capture to assassination; who it
was that was to profit by the assassination and that
would not profit by "the capture of President
Lincoln , who should succeed to the Presidency
in case a bullet made a vacancy.
Mr. Bingham replied: Iu the excitement and
hurry at the time it happened the report ot
my reply to the gentleman was the most imper
fect report ever sent to me of remarks made by
me in the nouse. Any gentleman may examine
it and will foil to fiDd in the correction a single
accusation that is not in my express words or
necessary implication in the reporter’s notes. 1
defy his calumny. What charge is he complain
ing" ot—that I said he had condemned without
knowing or caring anything about the evidence ?
I say so yet. It lie is the lawyer he is reputed
to be, he is to be pitied for coming here and ar
raigning his peers for not consenting to admit
the testimony of a man accused made alter the
fact.
I defy him, by any investigation which he dare
institute here, or anywhere, to show that any
communication came into my hands purporting
to be the production of J. W. Booth that was not
made after this tact, and loDg after this fact. Is
there any lawyer in America or England who
would say words and declarations of an accused
felon after the fact is evidence which the advo
cate of the government is hound to admit in any
court ? I treat with contempt and scorn any in
timation, from any quarter, that I or my asso
ciate counsel were under obligation to admit any
such evidence. The law does not require it.—
The common law—the growth and gathered wis
dom of a thousand years—excludes it. Perhaps
that great genius ol the unconquerable hero of
Fort Fisher—[Laughter, which the Speaker en
deavored to suppress.]
Mr. Butler tried to get in a remark, but Mr
Bingham would not let him, here adding that
the gentleman from Massachusetts had no right
to ask favors at his hands.
Mr. Bingham continued—I never saw any
memoranda by J. W. Booth which indicated any
plan or motive by which he was to carry out his
projected conspiracy. 1 never saw any such
thing, and 1 am not surprised that the gentleman
would not let me see the book which he put into
his pocket.
Mr. Butler again essayed to make an explana
tion, but with no better’resnlt.
Mr. Bingham said, no sir, I do not care about
it; having refused to let me inspect the book on
which he based his charge, he may now imitate j

gentleman talks of a spoliated book. Who spo
liated it? That is about as interesting a query
as that which I referred to the other day: Who
silled Cock Robin? Who knows that it is spo
liated? If J. W. Booth tore pages out of it, was
that spoliation? The gentleman’s words are as
impotent as they are unwarranted ; let the galled
jade wince, my withers are unwrung.
I challenge him, I daie him here or anywhere,
in this tribunal or any other tribunal, to assert
that I spoliated. Such a charge a3 that, without
any evidence, Is only fit to come from a man
who lives on a bottle and is fed with a spoon.—
[Laughter.] What is the other statement here,
showing the heart!essnes3 of the accusation, its
utter disregard and contempt for all decency and
al! law ? It is that I controlled the court. The
gentleman knows that I was not the official or
gan of the court. He knows its Recorder was
the Judge Advocate General of the United States,
and yet I am to be at fault because I did not
overrule the official organ ot the court. The
gentleman has uudertaken a task entirely be
yond his powers.
Let the gentlemaD read my argument on that
subject, and let him show wherein it is false, cor
rupt, malicious and unjust.
