Charleston Mercury writes :
Alter all the chances are that tho President
will, either have to release Jsflewou Davis, or
suffer him to die lu prison. A few weeks ago
his trial was regarded ns fixed tor some time
next month. Now, little or nothing is said
about it. The Atorney General, as will bo seem
above, is engaged with other matters. Clmso is
on tho Supremo Bench, and Underwood is
■nixing In negro meetings in East Vlrgiula. Tho,
truth Is, there is not a well, inlormed Radical
politician in tho country, who actually desires
the trial of Mr. Davis tielore tho next Presiden
tial election, because his trial will be fatal to
their peculiar heresy regarding the status ot the
unrepresented States. If trlcti at all, it must be
on an indictment lor treason, and if—as claimed
by the Radicals—his State (Mississippi) went out
of tho Union hy vlrturo of the ordinance of
secession, he cannot be convicted of any oflense
against the laws of tho United States, not being
a citzen thereof. If on the other hand It shall
l* decided that lie is, and was during the war,
amenable to tho laws of the United States—then
his State to In the Union, and has been all along,
the ordinance of secession to the contrary not
withstanding. It Is to avoid this knotty question
that the Radicals generally prefer that Mr. Davis
should not bo trieu, and In all probability it is
the true reason why Chase, Undorwood and Co,
are so slow to commence the trial.

. Newspaper Criticism.—General Hurlbert, of
Memphian notoriety, delivered a lecture in Chi
cago a few nights ago, which is pretty liberally
criticised by the press of that city. For exam
ple, the Times says:
Under the skin ot a republican—no matter
whether he be disguised as a major general, a
lecturer, & legislator, or a lawyer—there isalways
the fanatic. Such a one whether speculating iu
cotton, suppressing newspapers, getting glorious
ly drunk, or runnldg away from an enemy, al
ways does it with an eye single to the glory of
his taith. In all that he does, he manages to
hiugo it somehow on the •' interests ot God uud
humanity." He cannot even lecture Before a
crowd of unleathered students without an eulogy
of the pilgrims and the Mayflower; and an
apotheosis of tho “ groat moral ideas ” which
underlie the raid ol fanaticism against die gov
ernment, and the rights of States and citizens.
Tue Trial op Jepp. Davis.—Mr. Davis
must be tried at no distant day, or not at all.
According to the Act of 1790, under which he is
arraigned, “ No person or persons shall be pros
ecuted, tried, or punished for treason or other
capital oflense aforesaid, wiltul murder or perju
ry excepted, unless the indictment for the same
shall be found by a grand jury within three
years next after tho treoson or capital oflense
aforesaid shall be done or committed.” As the
war ended In April, 1805, the time for holding
Jefferson Davis under charge of treason, has
nearly expired. It would bo a strange finale to
the drama of secession and civil wnr, it the
leader of the opposition to the government
should escape a long-threatened trial for treason
by the remissness of his prosecutors; yet not
more Btrange than the repeated postponement of
his trial has been.
More About Jeff. Davis.—A Washington
dispatch to tho Cincinnati Commercial says: In
telligence was received to-day from Richmond,
which shows that it is alter ail again in doubt as
to whether Judge Underwood will essay tho
trial of Jefferson Davis at the .May term of tho
United States Court. If the term is adjourned
without such trial, the President has determined
to release Mr. Davis from confinement ot Fort
ress Monroe, on nominal bail. Tho President
has in hia posses- ^aicr.jik/nail liu u^-a
Republicans, asking that Davis he released, and
also a proposition Irom Horace Greeley, offering
to be one of Davb’ bondsmen.

Mil. Editor—A wise and good man stated to
me on the day of the execution of Mrs. Surratt,
“ that in less than ten years the namo of bvery
man connected witli her murder would lie held
in execration by the American people." This
prediction was uttered at a time when’the minds
of men (nnd women too) were heated with pas
sion, ami when to accuse was to convict.
Little did I think then that this prophecy of
my friend wns to be fulfilled, and still less did I
think that a great lender of the Radical party
who hounded her on to her martyrdom, would,
iu less than two yonrs from hor death, he heard
on the flsor ot Congress proclaiming iter inno
cence, and holding up to public execration the
man, who, next to Holt, is responsible tor the
murder of this innocent woman. In vain, Mr.
Bingham, will you appeal “ to the charitable con
sideration of your contemporaries aud posterity.
That mercy which you dealt out to this poor and
friendless woman will be shown when you and
your colleagues in guilt shall sland before the bur
ot a public opinion, unswayed and uninfluenced
by the passions to-whieh you pandered tor the
purpose of procuring tiic conviction of yonr help
less prisoner. The torture, the agonies of her im
prisonment, unsurpassed, unequalled by anything
recorded in the dark nunals of the Inquisition,

and quick refiartee enabled you, to some extent,
to parry the blows of Gen. Butler, but lot me
toll you, sir, that when he proclaimed his belief iu
the innocence of Mm. Surratt, his words were
caught tip and echoed back by millions of gen
erous hearts iu this country,’North and South,
who are ready to joiu in the chorus of, execra
tion, awaiting you and your aiders aud abettors
in this legal murder.
Bnt my object in writing this article was for
the purpose of availing myself of (he returning
sense of justice in the minds of the public and,
to offer a few words ia defense of this unfortu
nate woman. That “ site was a Christian lady "

would have been given unless they had been

rors of her prison cell, won the admiration and at
tracted to her the sympathy of her bearded jailors.
I do not consider now the solemn declaration of
her innocence made by that fearless and stoical
prisoner, Payne, ns he stood iu the shadow of
death, but 1 pass to an incident in the last act of
this bloody drama, which, to my mind, more
than nuy other, confirms the assertion of Butler,
that “ innocent blood has been shed by this ille-
iral tribunal "

Her appeal for a few days in which she might
prepare her soul for eternity, had been denied.
In twenty-tour hours the cruel sentence ot tho
Inw was io be executed. Slto met her fate with
the same Christian resignation which had marked
her conduct during her severe imprisonment.
She availed hcrselt of tho services of the minister
of religion, who was ndmitted to see her "on
certain conditions,” and when, on the morning
of her execution, she was raiBed, by two soldiers,
from the pallet on which she had spent so many
hours of agony, lien calmness and resignation
gave evidence that she had made her peace with
her God. As she went tottering to the gallows,
site turned to her clurgyinnn anil said, " Father,
I am innocent. May I not toll these people front
the gallows that I atn not guilty?" “No, no, my
child,” said ho, "it will do no good. It might
disturb the present composure of your mind.
Do not fear; justice will yet be done to your
memory.” She nodded her assent, and, with
this declaration of Iter innocence, she mounted
the scaffold and passed irom there to eternity.
Christian men and women of this country,

Peculiarity of the Seasons.—The season
thus far is certainly peculiar. One day we have
almost a June atmosphere, with free instalments
of thunder and lightning—followed by a tem
perature cold enough lor March.

hy lightnin^in various parts of the country, while
the earthquake that seems to have shaken up
Missouri and Kansas a low dayB ago, Indicates
commotions of a subterranean character, any
thing but agreeable for those who are within the
sphere of their influences.

Boyb.—Mr. James Waters, a man of family,
living in Bonne Femme Bottom, below Burling
ton, Boone county, Mo., was lately presented
by his wife with four six pound boys at a birth,
all living aud hungry. Mr. Waters’ family has
accumulated six boys in less than a year. The
previous rate ol increase had been two boys a
year for three years. The facts are well au
thenticated by physicians and neighbors, and
these accessions to population are considered
fair for a new country.
Arkansas.—A dispatch from Little Rock
The Head ok a Dead Man.—Tito Paris cor
respondent of the Pittsburg Gazette tells the fol
lowing story;
A poor fellow was guillotined ltore a few days
alter our arrival. According to the custom his
licud and hotly were given to the surgeous for
the “advancement of science." An experiment
was tried with the itead witli a very interesting
result. They injected into its arteries, fresh ar
terial blood taken from a dog, and shortly after
wards the head gave unmistakable signs of life.
Tito color returned to Lite cheeks and lips, the
eyes opened brightly and gazed upon those
around, the lips moved as it attempting vainly
to speak, and the entire face bore tho semblance
to active life. So soon as the operator ceased to
inject the life blood of the dog, the appearances
ol death rapidly succeeded. It was earnestly
held by tho eminent surgical gentlemen iu atten
dance, that during tho operation the brain was
in full ami natural action, and that the lips tried
to utter the last thought which found resting
place in the mind of the condemned.

tration-officers are to be appointed in each dis

two citizens. Cunningham, the Stale Treasurer,
has been dismissed, being incompetent to bold
office under the Congressional acts. Col. Rage,
S uartermostcr, baa been appointed in bis place.

gistration of voters will commence speedily.
The Honors to toe Dead.—We clip the
paragraph below from the Columbus Enquirer
of Saturday ;
The ladies of Columbus yesteiday paid their
annual tribute to the Confederate dead who sleep
in our city cemetery. All the proceediugs were
befitting the solemn occasion, and characteristic
ol woman’s holy devotion and patriotism. At
noon, Temperance Hall was crowded to hear the
address ol the occasion. Alter an impressive
and fervent prayer hy the venerable and beloved
Dr. I.. Pierce, Dr. E. F. Colzey delivered a beau
tiful aud appropriate etiology of the fallen brave.
I The floral decoration of the graves of the soldiers,
I in the afternoon, wns very handsomely and taste
fully perlormed, and the whole pageant was stri
kingly illustrative of the sentiment of the South
ern poet Henry Timrod—
“There la no holierapot of ground,
Than where defeated valor lie®,
By mourning beauty crowned.”

Virginia.—Gen. Schofield, commanding in
Virginia, has issued an order providing that tem
porary appointments to fill vacancies occurring
in city or county offices, will he made on the
joint recommendation of the Couuly Court, and
City Council, and President of tho Legislative
Board, and officers thus appointed will be sub
ject to State laws the sarao as if appointed by
the people.
Killed by Rattlesnakes.—Joint Titus, aged
ten years, whose parents reside at Villa Ridge,
sixteen miles from Cairo, accidentally stepped
into a crevice near his home, which proved to be
a den of rattlesnakes. The reptiles bit him so
that he died in twenty-four hours. The weather
not beiug warm enough to have entirely restored
snakes to their full vigor, citizens lound ami
killed them. ^
Earthquake.—Several severe uliocks ol
earthquake occurred at different points in .Mis
souri on the afternoon of the 24th. Houses
shook, doors and windows rattled, aud every
body rushed into the streets affrighted, fearing
destruction if they remained. No poison was
injured. Parties walking on the streets state
that it felt as though they were walking on a
spring plank.
The Flood.—A dispatch from bt. Jo, says
The river is one foot higher than in June last,
and nothing equal to the present flood has been
known for twenty-seveu years. The Missouri
bottom, two or three miles above this city, ia
overflowed, and tho residents thorn have been
obliged to remove their household goods to the
tilgh lands. Itnmenso quantities ol cord and
drift wood arc floating down.

witness, nor shall the neglect or refusal lo testify
create any presumption against him, nor shall
any reference be made to, or any comment upon,
such neglect or refusal.

try. The tax assessed for business done during
the month of March, was $31,849 87, which
shows a larger business than was ever done be-
lore in one month. The value ol shoes sold in
that city during the month of Jauuary, according
to the returns, was $393,373; ift February, $1,011,
519; and iu March, $1,255,454. The total value
of the goods sold during the last three months,
was $2,063,840/
The Patriots.—The bankrupt law passed
by the 39th Congress creates about two hundred
aud fifty new offices, to be filled hy appointment
by Chief Justice Chase. To the prosent time,
upward of eleven tbousaud applications for
appointment have been received: Ol course
no man applies to Judge Chase for an office
who is not vory loyal.
