expressed in yours ol the 7th. I have never dto-

In my view. Reconstruction it the paramount

A. to “ ltellelI um sorry that this question

liop h i.- been raised aud I shall meet it.
I hare looked anxiously for some constitu-
i. nal plan by which the debtor can be relieved
and justice can be done the creditor, and huve
found none but the Bankrupt Law. If the ex
emption under that is too small, Congress might
lie urged to enlarge it, but no other help do I
.ee that ;an be given by law. The mildest form
nl relief—the slay law—ia held by most of our
irists to be unconstitutional, and so bus bceu
pronounced by Chief Justice Chase at Raleigh.
H w, then, can broader measures staud the teat ?
rho advocates of relief in Georgia have pro-
pised no distinct plan. This shows that they

when you pass laws to preveut the creditor from
g-oimr what he contracted for.
In my feelings, and iu advice to friends and
clients. I aui tor compromise, forbearance and
concession, according to the moral equities of
each particular case. But these equities are not
,1 -riuable or enforceable by law. Practically,
iline-fourths of the debts of the country will be
. t, from the inability of the debtors. Is it not
-ugh for creditors to lose their slaves vnd the
l.-priciation of other property to the same ex-
t.-ut as other men, and three-fourths of their
debts besides ? Aud is it just to impose an
them also the loss of such debts as the debtors
ire able to pay ?—tor only such can he collected
under our present laws.
When the debtor is overwhelmed, the Bank
rupt law will disencumber him for the future.—
Some amendment ought to bo made to this law
K r instance, its relief ought not to be withheld
i:,-m fiduciary debtors—guardians, Ac., where
1 v inability to respond arises from enraucipu-

this, with other improvements, will soon come.
These are very hard eases on both sides. Ma
ny excellent people will be reduced, if debts are
collected, and many, also, if debts are not col
lected. There are many poor creditors as well ■
a* poor debtors. Between these unfortunate i
classes, both deserving sympathy, I see no course ; Th# L**ii#»e*peciaiiy are invited to call and examine

more necessary to ‘‘strengthen the things that
remain."
Think of this :—that if Georgia should try
some such scheme as enlarging the exemption,
and our courts should sustain it, then Northern
creditor* (and Southern too) would induce Cou-
gres9 to allow all creditors to force their debtors
into bankruptcy, where they would get only the
moderate exemption allowed there. In truth,
much of this hope of relief is stimulated by am
bitious men, who are deceiving the people with
promises that never can be fulfilled, well know
ing that the judiciary will overturn their work.
These are my views. I do not conceal them.
If any of my friends In Oglethorpe choose to
oppose me for honestly entertaining them, and
irankiy expressing them, I shall regret it on their
account as much as on my own. When good
men are deluded into the support ot so eztrava-
cant a heresy as repudiation, they are laying up a
cause ot tuture mortification and repentance.
Convince me that these views are wrong, and I 1
will instantly renounce them. Until so con
vinced, they will govern my conduct
I iesire that sound men shall be in the Con- :
veutiun—friends ot Reconstruction and of an
.nest Constitution, and shall be happy to eo-
perate with citizens of your county and Madi-

never been “ confiscated.” It waa seized by the
agents of the Freedmen’s Bureau, and has been
