the year of our Lord one thousand eight hundsedarid
thirty-two. George H Sims executed and delivered
to your petitioner his deed of mortgage, bearing
date the .lay and year aforesaid, in and to a certain
tract or parcel of land, situate ill the ninth district oi
said county of Houston and known and distinguish
ed in the plan of said district by number two hundred
and thirty-five, containing two huudred two and u
half acres of land more orb-as, for the purpnre of xe-
curingthepayment of a promissory note of even date
With *be said mortgage deed, by which said note,, the
said George. H. Sims promised, on or before the fiist
day of J iunary next thereafter, to pay your pelitiou*
er or bearer two huudred dollars for vnliie received.
And your petitioner sailh. that although -said prt mis-
sory note haslong since been one, yet the said George
II. iSims bas no.t paid the same, or any part thereof.
Wherefore, it isnn motion, ordered, that un!e«x the
said George 11. trims do pay into the clerk’s office of
this court, the principle and interest due on said
promissory note together with the cost of this applica
tion, within six months from the date of this applica
tion. or shew sufficient cause to the contrary; that the
equity of redemption in Hroi to the said mortgaged
premises, be then and from thence forward, forever
barred and forecloeed. And it is further orde.red,
that a copy of this ride be. published in’ one of the
public gazettes of -this State, onre a month for four
month*, orsefved nn the said George H. Sims in per
son, three months previous to the next term of this
court.

HE petition of John Rawls shews to the Court
tha Pinkney Yarbrough, while in life, made
his bond, a copy of which is annexed, to Tuttle H.
Moreland, with Uriah Yarbrough in the sum of two
hundred dollars, conditioned thal ihe said Pinkney,
was to make good and lawful titles to lot number nine-
ty-three in the thirteenth district of said county, and
the said bond dated Dili January, 1822, and thal on
the 3(>th May, 1822, the said Tuttle II. Moreland as
signed said bond to your petitioner John i’nwls, and
that the said Pinkney has since departed this life, and
that William Byrd has administered oil said Pinkney
Yarbrough's estate, and that said titles have never
been made and executed. On motion of Arthur A.
Morgan attorney of-tlie said John Rawls,
Ordered, That 'he said William Byrd shew cause
in the time prescribed by law, why he should not
make and execute titles to said lot of land to the peti
tioner, and further, that this rule be served nn said
William Byrd, by publication in one of the public ga
