UPON the petition of John M. Berrien, of the city
of Savannah, attorney at law, fluting that he is in
poficfiion of a curtain vi ritttn agreement, made and
executed by and between Andrew M‘Credie, late of
the said city of Savannah, merchant, and the laid pe
titioner, bearing date the day of February, in the
present year, 1807, whereby the laid Andrew M‘C're
die covenanted, on or before the 10th day of March,
then nextenfuing, to make, execute and deliver to the
said petitioner, good and indcfeafible titles in fee sim
ple, to a certain lot of land in Broughton Street, in the
laid city of Savannah, being lot No. y, in Tyrconnel-
Jything, Darby ward, with the buildings and improve,
audits thereon ; and further (hewing to the court that
the laid Andrew hath departed this life wit! out exe
cuting the laid titles, and that, David M'Credie hath
taken upon himlelf the but then of the administration
ol the ellate ol the said Andrew, and also, further k-r
ting, th.it the faia petitioner now is, and always hath
been ready to do and perform all and Angular the co
venants in the (aid agreemen (tipulated to be by him,
the said petitioner, done and performed.

William M'Donald, formerly of the panlli cf Ft.
George, then province,now flats of Georgia, by w hich
he gave and convened uii'o his wife Margaret, his :

wards Mary Christie, and to the survivor or furviv
ors of them, their heir and alhgns forever, all hi:, es

situate, with the rights members and appurtenances to
