Whereas, a libel hath this day been filed, in
the admiralty court of said district, by Joshua
Barney, commander of the American- private
aimed schr. the Rossie, on behalf as well of
himself, as of his owners, officers, and crew*
against the British ship Princess Amelia, her
tackle, apparel and furniture, by which said
libel, the said libellant doth allege, propound
and declare, as follows, to wit.
That war and a state of hostilities ex ; st be
tween the united kingdom of Grcat-B fain
and Ireland, ahd the dependencies tbercof/ar d
the United Stales of America and their territo
ries, ’and captures and seizures of enemies*
property, authorised and enjoined on all officers
of the United States; that the libellant, there*
fore, in and wittythe said schooner, duly com
missioned and. authorised, agreeably to law,
and her officers and crew, oo the fifteenth day
of September last past, did subdue, seize anu
take upon the high seas, the said ship Princess
Amelia, of the burthen of about tons,
with her tackle, apparel and furniture, and
bath brought her into the port oFSavamab,
and within the jurisdiction of this honorable
couit, where she now is.
That the said ship Princess Amelia, at the
time of the said capture thereof, was under
the command of one Isaac Moorson, and had
on board besides the said commander thereof*
twenty-eight English mariners, and three Eng
lish passengers ; that the said ship .Princess
Amelia at the time of the time of the said cap-'
ture Was a British vessel, sailing under the
flag of Great-Britain, and owned and navigat*
ed by subjects of Great-Britain.
That all and singular (he premises are and
were true, public and notorious, and that by
the laws of the United States of America, as
well as by the law of nations, the said ship.
Princess Amelia, with her tackle,apparel, fur*
niture and gttns, became, and was, and is For
feited.
And the libellant prays that the said ship*
her tackle 8cc. may, by warrantunder the seal
of >his court, be attached, and the usual process
and monition of this court, in this behalf, be
made* and that the same may be condemned
as forfeited.
Now, therefore, you, the said marshal, are
hereby commanded, to cite and admonish all
and every person and persons having, or claim
ing any interest in the said ship Princess
Amelia, her tackle, apparel, furm'ure and
guns, or any part thereof, to be and appear at
a special 1 court of admiralty, to be held at the
court-house, in the city of Savannah, in saiddis-
trict, on the nineteenth day of October insu
fo answer in the premises, and to shew cause,
any they can, why the prayer of the libel
should not be granted; and whatsoever yciii
shall do herein certify to the judge of the said
court, at the time and place aforesaid, and
have you there this writ.
