jUvTry. But the question is asked, wttai pcwtr has Congress fr> set the families free ? This ie the single point on which [ shall exjvress an opinion. My answer ts r that Congress has precisely the same power to enfranchise the families that" it has to enfranchise the colored soldiers, nfjie two powers are coincident and from the flame source. It has already been *&U*n~d that Congress may enfranchise soldiers. XhiS has been done foyfjpleffltt statute, without ashy reference faxhe conduct of his pretended owners. If we never asked the reason for such enfranchisement, it must be found, first, lb nrSfctlcal necessity, that we may .se cure the best services of the slaves; and second, in its intrinsic justice and hu manity. In brief the Government; can not be so Improvident and so foolish, as t<trattempt to obtain the services of the slave at the hazard of life, without secur ing, to him the boon of freedom. Nor, if the? Government were so bereft of com mon sense as to forego this temptation to the enlistment of efficient service, could it be guilty of the unutterable *ess of using the slave in the na , defence and then returning him to bondage. Therefore, the slave who fights is enfrancised, but every argument, and every consideration which pleadß fo£ the enfranchisement of the family.— There is the same practical necessity or doing it, and the same unutterable shjijbbmess in not doing it. There is no pyuuSple of law better established than the rule that any acknowledged right caries with it all incidents essential to its exercise. Ido not employ technical jmguage, but I give the idea which is founded in reason and the nature of ihfctgsT It would be vain to confer a or a favor, if the means for its en joyment were denied, From this simple stj&ment the conclusion is irresistible, ta conferring upon Congress the power to. create an army, the Constitution con therewith all the powers essential exercise of the principal power.— If Congress can authorize the enlistment of slaves, as it unquestionably can, it may at the same time authorize their en- and by the same mason it.,may authorize the enfranchisement Os t heir families, and all this from the ne <csgfefty of the ease and to prevent an in toferabte meanness*, An English patriot, nearly two centuries aMj exclaimed, in memorial words, that aeTwould give his life to save his coun try but he would not do a mean thing to it. If there be any value hi this it may well be invoked when It is deliberately argued that the Nation al Government can create an army, and in this service can enfranchise the slave which it enlists, but that it is impotent +0 enfranchise his family. I know not bow we can use his arm, and ask ‘aim to shed his blood in our defence, and then hand over his wife and child to bondage The ease is too clear for argu ’nent. The human heart regrets this in sufferable pretention. But it is said the staVe has no fatally. Such is the argu ment ot Slavery. * For ail that he has, as wdl as all that he is, even his wife and belong to another. Surely this unrighteous pretension will not be made the apology for a denial of rights. If the amfly of the slave he not designated by saw, or by the forms of legal marriage, then it must be ascertained by the next best evidence possible* that is, by cohab itation and mutual recognition as man and wife; and any uncertainty in the evidence must bo regarded as a natural incident of slavery. As men cannot take advan tage of their own wrong, so slaveholders cannot on this occasion take advantage of Slavery. Any other rule would prac tically unite with Slavery U denying to the slave his wife and child. There is a well known French maxim which says i hat it Is only the first step which costs, cl Gen'tist f>te te premier pas qw ? cente." And on this occasion permit me to say that it is only the first stage of the argu ment which merits attention. Concede i&ftt the soidier -may be enfranchised, «and It follows that by the same coosti- power his family may be admit ted to an equal liberty. Any other con efasiou would be as illogical as it is in human, and discredible alike to the head and heart. There is no argument, vihether of reason or of humanity, for the enfranchisement of the soldier, which does not plead equally for that of his fam- ily. Nay metre; l know not hfrwwe 4 can cjspect/a* blessing on our anas while we fed so perform this duty. I cannot close what I have to gay without adding that in my opinion Congress at this mo ment is complete master of the whole question of Slavery everywhere in the ’ united States. Even without any ccn etftutloual amendments it efte sweep ft all out of existence precisely as rfc can re move Ay other otetrqctwn to the na tional defend, and ull this virtue Os a power as indisputable as the power to raise armies or to suspend the habeas corrrn Future generations will read with amazement that a great people, when their national life was asfeaUed, hes itated to exercise a power so simple and beneficent; and this hmazemeht will know no bounds aS they team that* Con gress higgled for months on the question whether the wife and children ot the colored soldier shohld be, admitted to Freedom. The question was then, taken on the reference of the resolution, and it was de cided in the negative, yeas, 15; nay3, 10. At the request of Mr. Saulsbury, who wished to debate the proposition, ftirther consideration of the subject was post poned.
