No person shall be eligible to tbe office of Governor who shall not have been a citi zen of tbe United States twelve years, aud an inhabitant of this Stale six years, aud who hath not attained the age of thirty years. 4. In case of tbe death, resignation, or disability of the Governor, the President of the Senate shall exbreisa the executive pow er® of the government until such disability be removed, or a successor is elected and qualified. Aud in case of the death, resig nation, or disability of the President of the Seuate. the Speaker of the House of R*pre santatives shall exercise the executive pow er of the government until the removal of the disability or the election aud qualification of a Governor. 5. The Governor shall, before he en'ers on the duties of liis office, .take the following oath or affirmation : “I do solemnly swear or affirm (as the cage may be,) that I will faithfully execute the office of Governor o! the State ot Georgia; and will, to the best of my abilities, preserve, protect and defend the Constitution thereof, aud of the Consti tution of the United States of America.” Section J. 1. The Governor shall be Commauder-in- Chief of the army and navy of this State, and of the militia thereof. 2. He shall have power to grant reprieves for otfionces against the State except in cases of impeachment, and to grant pardons, or to remit any part of a sentence, in all cases after conviction, except for treason, murder, or other capital offences in which cases he may respite the execution aud make repoi i thereof to the next General Assembly. 3. He shall issue writs of elections to fill vacancies that happen iu the Seuate or House oi Representatives, and shall have power to convene the General Assembly on extraordi nary occasions ; and shall give them, from time to time, information of the state ol the republic, and recommend to their considera tion such measures as he may deem neces sary and expedient. 4. When any office shall become vacant by death, resignation or otherwise, the Gov ernor shall have power to fill Such vacaucy unless otherwise provided for by law ; aud persons so appointed, shall continue iu office until a successor is appointed agreeably to the mode pointed out by this Constitution, or by law in pursuance thereof. 5. A person once rejected by the Senate shall not be reappointed by the'Governor to the same office during the same session or the recess thereafter. 0. The Governor shall have the revision of all bills passed by both Houses, before the same shall become laws, but two-thirds ol each House may pass a law notwithstanding his dissent; and if any bill should not be re turned by the Governor within five days Sundays excepted after it ha 9 been present ed to him, the same shall be law, unless the General Assembly, by their adjournment, shall prevent its return. Ho may approve any appropriation and disapprove any other appropriation iu the same bill, and the latter shall not be effectual unless passed by two thirds of each House. 7. Every vote, resolution,or order, to which the concurrence of both Houses may be ne cessity, except on a queslion of election or adjournment, shall be presented to the Gov ernor ; and before it shall take effect, be ap proved by him, or being disapproved, shall be repassed by two-thirds of each House, ac cording to the rules aud limitations pre scribed in case of a bill. 8. There shall be a Secretary ot State, a Comptroller General, a Treasurer, and Sur veyor-General, elected by the General As sembly, and they shall hold their offices lor the like period as the Governor, and shall have a competent salary, which shall not be increased or diminished during the period fur which they shall have been elected. The General Assembly may at any lime consoli date any two of these offices, and require all the duties to be discharged by one officer. '•>. The great seal of the State shall be de posited in the office ol the Secretary ot State, and shall uot l>e affixed to any instrument ol writing, but by order of tbe Governor or General Assembly, aud that used previously to the year 1801, shall be the great seal of the Stale. Tbe Judges of the Superior Court shall be elected on the first Wednesday iu January until the Legislature shall otherwise direct, immediatelv before the expiration of the u-rm for which they or either of them may have Ix-en appointed or elected, from the Circuits in which they are to serve, by a ma jority vote of the pepple of the Circuit quali lied to vote for members of the General As sembly, for tbe term of four years—vacan cies to be filled as is provided by the laws of force prior to Jannary Ist, fß6l—and shall continue in office until their successors sha 1 be elected and qualified ; removable by ihe Governor ou tbe address ot two-thirds of each brauch ot the General Assembly, or by impeachment and conviction tliercou. 2. Tbe Superior Court shall have exclusive jurisdiction in all cases of divorce, both io lal aud partial ; but no total divorce shall be granted except on the concurrent verdicts of two special juries. In each divorce cast, the Court shall regulate tbe rights and dis abilities of the parties. 3. It shall have power to issue writs of mandamus, prohibition, scire facias, and all other writs which may be mcess&Ty for carrying its powers fully into effect. t*. The Superior Court shall have jurisdic tion in all other civil casee. and in them the General Assembly may give concurrent ju risdiction to the Interior Court, or such other county courts as they may hereafter ere ate, which cases shall he tried in the county where the defendant resides. 10. In cases ot joint obligors, or joint prn missors or copanuers, or joint trespassers residing in ihfi reut cAuutiea, the suit may be brought in either county. 11. Iu case of maker and indorser, or in dorsers ot promissory notes residing iu dif ferent counties in this State, the same may be sued in the county where the maker re sides. 12. The Superior Court shall sit in each county not less than twice iu every year, at such stated times as have been or may be appointed by the General Assembly, and the Inferior and Couuly Court at such times as the General Assembly may direct. Section 3. 1. The judges shall have salaries adequate to their services fixed by law, which shall not be diminished nor increased during their continuance in office; but shall not receive any other perquisites or emoluments what ever, troin parties or others, on account of any duty required of them. v There shall be a Slate’s Attorney and Solicitors elected iu the same manner as the Judges of the Superior Court, and Commis sioned by the Governor, w'bo shall bold their offices for the term of four years, or until their successors shall be appointed aud qualified, unless removed by sentence on iiu peacbmcn I, or by the Governor, ou Hie ad dress of two-tbirds of each branch of the General Assembly. The Justice or Justices of the Inferior Court, and the Judge of such other County Court as may by law be created, shall be elected in each county by the persons en titled to vote for members of the General Assembly. 4. The Justices of the Peace shall be elected in each district by persons entitled to vote for members of the General Assem bly. r>. The powers of a Court ot Ordinary and of Probate, shall be vested in au Ordinary for each county, from whose decisions there may he an appeal to the Superior Court, under regulations prescribed by law. The Ordinary shall be ex officio clerk of said Court, and may appoint a deputy-clerk.— The Ordinary, a* clerk, or his deputy, may issue citations, and grant lemporarv letters of administration, to hold until permanent letters are grauted ; and said Ordinary, as clerk, or his deputy, may grant marriage licenses. The Ordinaries in and lor the re spective counties shall be elected, as other county officers are, on rite first Wednesday in January, 1868, and every fourth year thereafter, and shall be commissioned by the Governor for the term of lour years. In case of auy vacancy of said office of Ordinary, from auy cause, Ihe same shall be filled by election, as is provided in relation to other county officers, and until the same is filled, tbe clerk of the Superior Court for the time being, shall act as clerk ol said (Jouit of Or dinary. ARTICLE V. Section 1. 1. The electors of members of the General Assembly shall he free white male citizens of tliis Slate, and shall have attained the age of twenty-one years, and have paid all taxes w hich may have been required of them, and whrch they have had an opportunity of pay ing agreeable to law, tor the year preceding the.elertjon, shall lie citizens of the United States, and shall have resided six months either in the district or county, aud two years within this State, aud no person who is not qualified to vote for members of the General Assembly shall hold any office in this State. it.
