But one case wm tried before this court yesterday being that of State vs. Isaac T. Crawford, charged with assault and battery, committed upon Robert on the 10th of January last. It appeared in evidence ihat on the evening of that day while acme half . doaen Germans were standing at the door of the Turner HaU, comer of St. Julian and Jefferson streets Craw- ford appmschedthe party and addressed them in a decidedly rough manner. Upon one of them remon strating at his conduct, Crawford attacked Stack, who waa not the person miking the objectionable remarks, and severely handled him. It wm claimed, in de- fence, that Crawford was justifiably resenting appro- brions language applied to him. although his assault wa# directed by mistake against the wrong individuaL The jury rendered a verdict of not guilty. Counsel for defendant, R. E. Lester, Esq. The disposal of this case finishes the criminal doc- ket, and the jury wm discharged for the term. Freedman’s Court, ^ In the case of Mrs. Welsh, alias Higgins and Thoa. Neeley, charged with receiving goods stolen from the Messrs. Rutherford, Judge Pollard decided to turn the whole matter over to a military commission. An investigation of the charge made against Judge Pollard for liberating the negro Middleton from the chain gang after a sentence of six months, and taking one hundred and fifty dollars for the fine, wm had by Capt. Eastman, Provost Marshal. Witnesses were ex amined, but the cue wm not decided at the adjourn ment. In our report yesterday we were made to say that the Judge liberated the negro on an order from CoL Kimball. Such was not the cue. Neither he or the Provost Marshal had anything to do with the case. It was an order from the agent of the Freedman’a Bu reau. The negro Middleton has been re-arrested and held in *1,000 bonds, by consent of Lt. Bronson, to be turn ed over to a military commission to snswer the charge of stealing the tobacco from the store of Mr. Nixon. It appears that this Court hu only power to sentence for the term of sixty days, but can also fine to the amount of one hundred dollars. Cases requiring greater punishment have to be turned over to a com mission. I Recovery or a Bair or Cot ton. I Yesterday morning, between two and three o’clock, VPoliceman Jim. The Orphans’ Benefit at the Circus. The public will bear in mind that the benefit gen erously tendered the Orphan Asylums of Savannah by the managers of the Circus at present sojourning in the city, takes place this afternoon. An oppoTtuni- ty is afforded in this benefit to attend perhaps the best exhibition of the kind ever presented in thi» city, comprising m it does aU the attractive and entertain ing features of the ordinary circus together with the instructive and highly interesting exhibition of wild beasts—and also to contribute a mite towards the sup. port of the noble charities of Savannah. The time of the performance being in business hours, a large por tion of the business community will perhaps find it impracticable to avail themselveB of this opportunity, but nothing will prevent the ladies and children from turning out in full numbers, and every citizen should see that he is well represented among them. This golden moment for insuring a substantial harvest for the Orphans, whose “benefits” have not unfrequent' ly redounded more to the benefit of others than to themselves, will not we trust, be suffered *to pass by unimproved. Tickets for the Orphans’ Benefit this afternoon can be obtained at J. <J. Schreiners & Son’s, W. W. Lincoln's Drug store, Orff & Watkins, A. A Solomons & Co. |Cooper, Olcotts & Farrelly, office of lerk of Council and at the usual places. Sudden Change op Weatheb.—After the mild and pleasant weather of the early part of the week we ha\w experienced a rather severe and sudden change. On Wednesday evening it commenced raining with the wind from the north-west, but towards morning i* cleared off and commenced blowing at a tremendous rate, which continued all day yesterday without any appearance ol abating at the time of writing. The change has been very great and its suddenness has caused it to be the more keenly felt. ■— Trial befobe Military Commission The mili tary Commission of which Capt. J. H. Watson is Judge Advocate, will this morning take up the case of Ehler D. Meyer, charged assault with intent to kill a freed- man named Stephen Decert, on the 17th of January last. The accused wus examined before the Freed- men’s Bureau some time since and turned over for trial before a military Comission.
