The traeTc designated for the Georgia com
pany, was bounded on the north by the 34th
degree of north latitude, 00 the raft by the
Alabama river, on the wdl and fotuh by the
Mobile or Tombigbec, from the Spaniih
line to the north esit corner of the lands al
ii gneci ro the Georgia Midi dip pi company, by
the northern boundary of the laid lands* and
by the Milfifsippi j for which they were to
pay 250,000 do lars.
The Tenndfee company were to pay
dollars, for a rract lying between the northern
boundary ofthe Rate, and the parallel of lati
tude palling by the head spring. of Bear-creek,
and counded.on the weft by TenndTee and
Bcar-cretrk, and on the eatt by a meridian
eroding the lad mentioned parallel, 120 miles
east from the luurce of Bear-crcck.
And the Upper Mifsifsjppi company were,
in consideration of 35,000 dollars, to receive
a trafl of 25 miles in breadth, adjoining the
northern boundary of the flare, and extending
fro i the Mrfsifsippi to TennefTee and Bear
creek, its boundaries on the east.
Two millions of acres were reserved out of
these several trails, for the life of luch citizens
of Georgia, as chose to fubfcrlbe on the ori
ginal terms of the purchafc : the monies paid
by thole citiz-ns to the ftace, being considered
as part of the purchase money of the compa
nies, in whose territory theyTubfcribed ; ;he
quantities thus rdcrvtd out of each trad, being
one milhon of acres in the Geqjrgia company ;
620,000 acres in the Georgia Miflifiippi com*
pany j 242,000 acres in the Tenneftee com
pany; and 12‘d,coo acres in the Upper Mis
fiff>ppi company. The price paid bv the
citizen*? who did fubferibe, was two cents and
one third per acre, it being the price then
supposed to have been paid by the companies;
which, (500,000 dollar?, being rhe purchaft
money,) would give about 21,500,600 acres,
for the estimated quantity of land in the four
tracts. It was further declared bv the acl, that
the lands lying weft ward of iheeaftward boun
dary of the kvernl companies purchase, were
eftimared at one third of the lands within the
purchase ; and ware luppoftd to contain
7,250,000 acres, which would give 2!,750,000
acres, for the quantity intended to be fold.—
The land contained within thole purchaies,
amounts, however, to near 35 millions of
acres; and the prefect claimants ellimate the
quantity at near 40 millions of acres.
The several companies did, it is underflood,
pay the purchase money, and obtained grants
horn the governor of Georgia, for the several
cradts defigrated in the law : the lands have
since pafied through several hands, and ft far
as h is come within the knowledge of the com*
mifsicners, the title derived from the grants
appears to now held in the following
manner :
The whole granted to the Georgia
Mifsibippi company, was divided into sixteen
‘hundred equal undivided Bures; and the pre
lident and dire&ors of the company, in Jan
uary, 1796, fold the whole, with the exception
of tne 6:07000 acres, reserved for citizens’ fab

conveyed to iru.tees, for the use of the com
pary, which con lifts of 2.276 tqu'al snares.
It is urged by iundry alfociates or sharers
of the original Mifiiffippi company, that they
have not been paid, and that they are ftdi
entitled to a portion of the land.
The trad granted to the Upper MtfOniippi
company, appears to be divided into twelve
equal undivided ftiares, and to be unemang
led miliant claims.
The tract granted to the TennefTee com
pany, by the grantees, Mathias Maher
and Zachariah Ccxe, divided into 240 equal
flu res. Several hundred thousand acres are

Thst company, however, no longer exists,

On the 13th day of February, 1796, the
Leg flature of Georgia patted an act, (L)
declaring the a6t of the 7th January, *795*
abovementioned, null and void, as having
been obtained by fraud and corruption; di
recting all records of grar.ts or conveyances
relating to the sale, robe expunged ; forbid
ding the recording, thcreate r, of any such
conveyances or contracts. The document
(F) contains the evidence on which the le
giftature adted.
By the articles of agreement‘of the Geor
gia company, and the schedule thereunto
annexed, bearing date ift and loth January,
1795, a copy of which (B No. 9) was trinf
mirted to the committioners amongst other
documents, by the attornies of Hugh Rofc
and Valentine Jones, two of the claimants
under that company, ic appears that the
company hid dTpofedof a confi ierable quanti
ty of the Ends they intended to purchase, to
divers persons (whose names with the amount
m dollars paid by each, appear in the fche
dulej for the purpose of raising a fund to
effedt the purchase of the lands; and that they
had also found it necessary to distribute to a va
riety of citizens of the state, certain sub-shares
or quantities of land, in order that the bene
fit lhould be as generally difFufed as poftibler
By the form of the sub ihare (C) it appears
that the holders were entitled to a certain
quantity of land, vviihout making any imedi
are payment, but on paying within seven
months v/hai was supposed the original pur
chase mony : viz. two cents and a third of a
cent per acre.
A companion of .he schedule annexed to
the articles, and which is declared to be a
pu t of the agreement, with the yeas end navs
on the pTiuge ofthe .act, authorizing the la!e,
(E) fhovts that all .'he members, both in the
lenate and houlc, who vrmd in favor or’ the
law, were, with one single e; ceptior (Robert
Watkins, whose name does not t.p ear; intrr
efted in, and parries to the purchase.
The articles of agreement, and lift ofaftoci

(hows that a number of members of the ieg

I: is also proper to state, that all the deeds
given by the companies, which have been
exhibited to the committioners, as web as
all the subsequent deeds, with only rwo or
three exceptions, not only give a fpeciai, in
stead of a general warrantee, but have also a
special covenant, in the following words :
“ And lailly it is covenanted, and exprcfsly
<( agreed and understood, by and betu een
ff the parties, to these prefems, that neither
<s the grantors aforefaid, nor their heirs, exe
“ tors, or adniiniftrators, fliall be held to any*
fc further or other warrantee, than is herein
ec before expreffrd, nor liable to the refund
ing of any money, in conlequencc #f any
<c defed in their title, from the Stace of Geor
<f gia, if any such there hereafter ap
“ pear to be.”
The ate of Georgia, of the igrh February,
1796, as well as several fb( queat a6ts,
nad made provision for the. repayment ot
the money, depofi.ed as the corfideration of
the purchaie; and the document (G) shows
that 3!^,695 dollars and fifteen cents, have
been withdrawn under chose laws. The com
m: ill oners have not been able to procure the
evidence, on which thole sums were paid ;
it is however, understood, that supposing the
trtfe from Georgia to have been valid* not
more than avc or fix millions of acres have
