COMMERCIALLY IMPORTANT.
To Merchants engaged in the shipping of
Uoods.
By a recent decision of the Supreme
Court of the state, in a case reserved for
the opinion of the whole Court, anew, and,
to you, a most interesting principle ofln
uranee has been decided, and which as it
runs counter to the universally received
doctrine among merchants, of Barratry,
vou will do well to remember. The cas.-
is iaggart, vs Loving, in the I6ih vol. ot
the ‘Term Reports, as follows, in substance:
“that Fisk & Bridge were the registered ow
ners of the schr. Blucher; that they charter
ed her on pmols evidence for six months,
ion half profits,to a captain Ternigan, in the
icoasting trade. Taggart’s friends at Phil
adelphia shipping 50 bbls flourin this ves
jsel, at an agreed freight, deliverable to
| Taggart at Boston. The master, Jernigan,
j being the pro hoc owner of the Blocher, in
stead of coming to Boston, as his bill of la
ding declared, run away with the schr. am!
j cargo, to St. Jago de Cuba, and there sold
land conveited the property to his own u“.
Taggart effected a policy of insurance in
| the usual form, with Loring,for an agreed
land usual premium from Philadelphia to
j Boston. Action bting brought against Lu
ring by Taggart, on the ground of barratry,
a species of fraud specified in the policy,
with the usual exception, “that the insured
was not owner of the vessel.” The Court
decided, that Jernigan, being the owner of
the Blucher, pro hoc, could not commit
barratry at all; and gave die cause to Lu
; ring. *
Fiom hence it follows, that a great, risk
that of the fidelity and fair conduct of the
master, in delivering the goods of general
shipper*, is at an end in the present poli
cies, as regards underwriters, provided the
master be a registered owner, or merely
hire or cliartei the vessel, and evidence can
be had of such hire or contract even by the
hearsay testimony of any two competent J
witnesses. It is therefore incumbent on
every shipper of goods, before he ships any
such, to most perfectly satisfy himself tliat
the master of the vessel is not all or part
owner by register, or has not hired the ves
sel For any term of time, or for any particu
lar voyage; because if he has, and he run
away with the property, the insurers are
not liable by this decision, and you must
bear the loss, having only the chance ol fin
ding the master in some other country for
recovery.
This is so novel a doctrine, and has such
consequences involved in it, to all those
engaged in the shipping trade, that too much
icare cannot be exercised in making these
| inquiries before shipping your goods
I Would it not be well for the real owners of
i the packets-in the various trades, to de
dare publicly whether the masters of those
vessels iiavc any such legal or acquired
ownership or not, as before stated, that the
great body of shippers may be aware of tilt
risk agair.st which the present form of the
policies now in use do not guard, and tliat
one of no small importance, and for which
a premium lias, until ibis decision, been u
niversally among us considered as paid ?

circumstances which ought not to pass un

property.

ford, his fees moderate on all such occasions.
