stating that ,M r. Warner, our consul at the Ha
vana is dead. It is proper to Male that so tar
from this being the case, he is now in this bo
rough, and in perfect health. The person who
died in that city, whose death has probably gi
ven rise to tne l-epott, i Mr Rails, who was left
by Mr.’ Warner to act in lus absence.

A great deal of confusion U now occa
sioned which will hereafter be increased
by the uncertainty attached to the term A
merican, when speaking of either the in
habitants or vessels of the United States
and the different nations of Spanish and
Portuguese Americans. The people whose
Independence we have recognized, are not
all inhabitants of South America, and yet
they are all Americans as well as ourselves.
It would perhaps be well to call the peo
ple of the United States J\Tortli Americans,
(though the inhabitants of Canada, Nova
Scotia are equally entitled to that appella
tion,) and their standard the North Ameri
can Flag. The Mexican Empire has a Hag
exclusively its own. The various nations
of South America, the Venezulian, the
Buenos Ayiean, the Chilian, the Peruvian
arid the Brazilian, will all be distinguished
by their respective colors, and have each
a distinctive name. The people of the U.
States alone of all America have no pecul
iar title except that of Yankee. Some ar
rangement ought to be made by which each
nation may be distinguished from the rest.

From Mexico. —The Aurora of the 22d
ins ant informs us that despatches were on
Saturday leceived from the city of Mexi
co, to the 29th of June, we have seen a let
ter from the emperor himself, of that date,
in which he expressly states that his eleva
tion to that title was not in conformity
with his own wishes, and that he submits
with the hope of being by that means ena
bled to maintain the independence and
promote the happiness of his native land.
More Plundering of Mails —The bun
dles of le ter-, at tin* Post Office in this city
yesterday, from N-*w-Orleans and Nash
ville,were discovered to have been opened,
and every letter, except the single ones,
broken open and again closed and reseuled.
The contents of about seventy letters have

Whereupon resolved that the communication
from the. Medical Society of this city in relation
to the act of the last Legi lature lor the sup
pression of Quackery be received and that the
same be published as is required by law, in all
the Gazettes in this city.

AN ACT
To establish a tribunal to enquire into the quali
fications of persons claiming to practice Ale
dicine, Surgery, fk midwifery, witbih the city
of Savannah, and to grant certificates to the
same if fonu l properly qualified.
Whereas, it appears by a memorial of the
Mayor and Aldevmen of the city of Savannah,
that the good people of the said city, and es
pecially the poor&. illiterate people tlierof, have
suffered heretofore muchevn from the want of
nroper laws to cgulate the practice of medicine,
surgery, and midwifery therein, the conse
quence of which want lias been the indisc imiii
ale and arsogant pretensions and Undertakings
of mam unlearned and empirical persons to
practice therein in the said arts: And whereas,
.sound police and a proper regard for tlye healths
mid lives of the Citizens of a commercial, popu
lous, and growing city, require that the legisla
ture should guard against suah an evil for the
future:
§ 1. Be it therefore enacted by the senate and
house of representatives of ttie state of Geor
gia in general ossetnbly met, and it is hereby
enacted hy the authority of the same, That the
Georgia Medical Society established in the city
of Savannah, shall be Invested with and poss
essed of full power and authority to examine,
inquire into, invest'gate, and determine on the
professional qualifications, attainments, and ca
pacities of alt and every person or persons
claiming to practice within the limits the said
arts of medicine, su’gery and midwifery, or in
any two or one of them, and to grant certifi
cates of qualification under the common sea!
of the said society, or, if there be. no common
seal, under the signs manucl of their presi
dent and secretary, to him, her, or them so
claiming amt making application therefore, it,
by a majority of said saciety, lie, she or they
.stia.il be deemed duly learned and qualified. And
it shall he the duty of the members of the sa.d
society, when application shall be rnnde by any
person or persons for his, her, or their examina
lion to the end aforesaid, to convene at their ex
ami nation to the end aforesaid, to convene at ;
their customary place of meeting, and to decide
upon the applicant’s petition, within ten days
after they shall have been summoned to convene
by their president, or in his absence, sickness
or other inablity, by the person or persons dis
cl.arcing his duties, or if there be m any such
person or persons, after shall have been sum
named by their secretary. And it shall be the
ill,tv of the said president, person or persons
performing Ins duties, or secretary, to summon
each and every member of the said society, *>y a
written citation, expressing the object ot the

or applicants, and the day of the

been made to him or them: Provided always,

severally take a solemn oath, to be admimsteied

and decide upon the attainments and qualifies
tipns of the applicant or applicants, and to grant
certificates ol qualification to him, her, or them,
if, in their judgments, he she, or they sh ill be
found duly learned ami q to practice in

ry, or in any two or one of them: And pro*l ’

setting forth any such failure or violation and
supp-rled by tins affidavit of the truth of such
petition, to grant as a matter of right, cf scire
iitcias, directed to the president and members
of said society requiring them to shew cause
at the next te m of the said court, why their
charter or act of incorporation should not be:
deemed fy if cited. A copy of this and of the
petition snail be served upon the president or
secretary, ami if the allegations be denied, an
issue shall be joined, and the facts to be tried by
injury einparuiclicd and sworn as in other esses,
h theallegations af the petition be luund to bo
true/or if they be admitted, and no good cause
be shewn for the former failure or violation, it
sha I be tlie duty ot the court, upon application
of the party injuied, to appoint a day not more
remote than ten day s, on which the society shall
convene, and conform in every thing to the re
quirements of tins act, and to the order for this,
purpose no return shall be received front said
society but one of absolute compliance under
oath of tlie President or Secretary; w hichre
lurn shall be filed ill the clerk’s office wi bin 5
days after the appointed day. On failure to
make such return, the Judge of said court shall,
in vacation, award a judgment of forfeiture
of the charter, upon application as atoresaid; and
execution snail issue for cos.s as ‘aforesaid.
§ 3. And be It further enacted by the authori
ty atoresaid, That if any person shall be refus
ed a certificate, he or she may again apply for
. examination, after a lapse of six months, and it
shall he the duty of the said society to receive

i each application to the provisions of this act,
i and subject to ail its responsibilities,’ provided
. the interval between any two applications be
: not less that six months
§ 4, And be it furl her enacted by the authori.
ty aforesaid, That if any person claiming to
practice in the said arts, or in any two or one of
them, in the said city, shall presume to do so,
openly or covertly, not having obtained a certi.
ficate of qualiucaiion, it shall not be lawful for
such person to recover in any court of law or
equity in this state, his or her fees or charge*
for services done within the city of Savannah,
nor shall it be lawful for any company or copart,
nersliip of ui(certificated persons, and such per*
son shall be moreover liable to prosecution by
indictment in the Court of Common Vk-as anil
Oyer and Termmer of said city, at the in*
stance of the mayor and aldermen of th
said city, or of any common informer—-
Bonds prosecution shall be given as in other
cases arising under the penal laws of this states
if at the instance of the mayor and aldermen,
the hond shail be given by some person acting
under their sanction or authority, otherwise by
the common informer, and upon the first con
viction, the accused may be fined by the court
in a sum not excedmg one hundred dollars, and
on each subsequent conviction, in sum not ex
ceeding two hundred dollars, besides cost of
prosecution in bach case: one half of the fines
! shall be paid into the treasury cf the city ot Sa
vannah, or to the common informer, and the
other haif shall be equally divided between the
Union Society and the Female Asylum Society,
for the benefit of the orphans and cluldret*
of said socitiea. ,
§ 5. And be it further enacted by the author
tv aforesaid, That no part of this act shall be so
construed as to effect any person or persona
now practicing, or claiming to practice in the
said city, in the said arts, or in any two or one
of them, and now residing in the said city, or
who shall lie engaged in the praeuce of the
same, er of any two or one of them t herein, on
or before the fir <4 day of Febuury next.
$ 6 And be it further enacted by the autho
rity aforesaid, That if the Georgia Medical So
iciety shall communicate to the Executive <.e
-----: part ment of this state, on or before the said
first day of February next, their acceptance ot
this act as an act additional to their cliai ter, and
that they are willing to be bound by’r.scondtions
and requirements, this act shall from thence
forth commence in full and complete operation,
but otherwise shall be totally null and void
And be it also enacted, that the said society
shall; before the said first day of Fe : >. give no
tice of their said acceptance to the Mayor ana
Aldermen of the said city of Savannah, whose
‘ duty it shall he to make said acceptance public
; bv advertisement in all the public gazettes ot
, the said city, three times a week, for the space
,of one calaiider month, ~ . ,
t 7 And be it further enacted by the autho
! rity foresaid, That in the event of the accept-
I „ice by the said society of this act, agreeably to
the aforesaid section, tliis act shall continue Un
[ til the first day ot January, one thousand eight
hundred and twenty-s'-x, and no longer.
