Trying It On Too Soon.
We learn that on the out-going train from
this place on Thursday night last, a mulatto
woman of questionable character took a seat
among tho white folk*—which, being discov
ered by the watchman, the waa requested
to take a aeat in the car appropriated to the
colored people. Two white men on board
told her not to do it—that the ci/il righto bill
had passed and that she had as good a right
there ae anybody. The conductor, however,
was of a different opinion, aod seated her
among the colored ponple.
We mention this occurrence te call the at-
tinn of Southern merchants to the fact that
the two men alluded to were " drummers” or
commercial travelers,”—one of them. Mr. Ad
ams, claiming to represent the bouse of R. H.
Millor, of Baltimore, dealer in safee, and the
other, Mr. John Dewils. representing the es
tabliebment of S. B. Condlct 4c Co., of New
York, dealers in saddlery. The gentlemen
naun-d certainly have the right to select their
associates, but if they desire to ride with ne
groes, they should go into the car appropria
ted to their use.
Men wno are seeking Southern patronage
for the houses they represent, will net meet
with any great success if they needlessly in
suit our people by such conduct ae above
described. Iu the first place, the civil righto
bill was not a law, and if it had been, the
native instincts of the Caucasian race sboold
have led them to sympathize with their own
color.

Death or an Old Citizen or Walton.
We received last week the melancholy In
telligence of the death of Judge Orion Stroud,
which occurred at the bouse of his son-in-law.
A. F. Nuunally, in Atlanta, a few days before.
The deceased bad been a citizen of Walton
county from iu organization, and even be
fore that time, and was about 80 years old at
the time of bis death. He was highly es
teemed in ail the relations of life, and bad ex
ercised great influence in all the interests of
the community with which he was so long
identified. He was probably known to and
respected by every citizen of Walton connty,
and will be long remembered for his many
virtues.
Anniversaries.
The anniversary of the Demostbecian Soci
ety was celebrated on Friday last, when Mr.
B. M. Hodge, the anniversary orator, enter
tained the audience with a very excellent ora
tion. Hit theme waa "Fiction,” and he ban
died the subject with great ability, as we are
assured by those who bad the pleasure of hear
ing him.
The anniversary of the Phi Kappa Society
occurred on Monday (22d of February.) Mr.
J. T. Graves, of Lee county, was the anniver
sary orator. His theme was “ Manhood,”
and he handled it with unusual ability. In
deed, we have rarely, if ever, beard such
warm encomiums bestowed upon any oration
on a similar occasion.
Supreme Court Decisions.
We do not pretend, as a general rule, to
publish tbe decisions of the Supreme Court h
our columns, but as the following cases pos
seas a local interest, we copy them from oui
Atlanta exchanges:
Mayor and Council of Athens vs C. W. Long
et si. Mandamus, from Clarke.
The charter of a municipal corporation gave
it power to levy taxes! thus: " Full power
and authority to levy and collect annual tax
of not exceeding one per centum upon tbe val
ue of ail property within the corporate limits,
of whatever kind, real or personal, which is or
msy be subject to taxation by laws of this
State.”
Held, That under this charter it is compe
tent for the mayor and council to exempt car
tain property from taxation altogether, provi.
ded that tbe tax laid be ad valorem, and uni
form upon every species of property taxed, as
provided for by Article 1st, section 27 of tbr
Constitution of tho Stote. Judgment reversed
Singularly retiring and modest, bis friend
ship was never obtrusive; it must be sought
for, and when it and tbe confidences attending
it, was given, it was an honor indeed.
We cannot associate with each a character
without feeling its genial influences, and hence
we offer the following resolutions:—
Resolved, That in the death of our fellow
member, Walter H. Griffeth, tbe Merchants,
Exchange has lost a valued member, and tbe
community a merchant whose integrity and
moral worth could not be surpassed.
Resolved, That, we tender to tbe afflioted
family our sympathy in tbeir greatsorrow.
Resolved, That, as fbrther testimony of oar
regard, wo will inscribe this preamble and
resolutions on uur record book, and tho mem
bers of tbe Exchange will wear a mourning
badge (or thirty days.
Resolved, That a certified copy of these res-
ilutions be sect to tbe family of our deceased
member.

Case from Clarke.
Wild Cats In Medium.
Mr. Isaiah M. White, a highly esteemed
citizen of Madison connty, informed ns one
day last week that he and bis boys had killed
and caught three wild cats since Christmas.
Ho has one of them alive at his boose, nearly
as large as a dog! We did not know that
any of these "varmints” were in the good coun
ty of Madison.

Adjourned Courts.
We have received communications from
different sources in regard to the failure to
bold Courts in Clarke, Walton and Jaokson
counties, and their adjournment to a period
when farmers are usually busy—Jane. It
should be remembered that Judge Bice is
sick, aod that this cannot be helped by him.
But, say these complainants, he might get
soino other Judge to sit in bis place. They
forget that the other Judges are bolding tbeir
own Courts, so that they cannot come to this
Circuit.
We do not write this at tbe request of
Judge Rice, not having had any correspond
ence with him—but as at. act of simple jus
tice—feeling qu'te sure that he would not
disappoint tbe people if he could help it.
1. Ou tbe trial of an action, for damages to
plaintiff's land, by back water from defendant's
mill dam, it appeared that it was only during
freshets and floods that tbe plaintiff’s land was
overflowed:
Held, That it was error in tbe Judge to
refust to permit tbe defendant to prove, that
not far below its dam, tbe banks of tbe river
were high and close together, so that when the
water rose so as to be two feet in tbe dam, tbe
water was as high below the dam as above it
2. In an action for damages to the plaintiff’s
had caused by tbe defendant’s mill dam. os
well as in other actions of trespass, if it ap
pear that" other and contiDgeutcircumstances
preponderate largely in causing the injurious
effects, such damages are too remote to be th
basis of recovery ”
It was not error in the Judge togranta new
trial in this case. Judgment affirmed.

TRIBUTE UF RESPECT.
Good Hope Grange. No. 345.
Whereas. In the providence of God, our
Bro. Frederick Barrett has been separated
trom us by death, the 20th of November last,
in his fifty-third year.
Resolved. That in tbe death of Bro Barrett,
mr community has lost a good and useful
citizen, the Grange an esteemed Brother, faith
ful and punctual in the discharge of all and
every promise and obligation made to his fel
low-men, kind and obliging to bis neighbors
almost to a fault. Being possessed naturally
of a kind and social disposition, full of fun and
humor as to strongly endear himself in the
hearts of his neighbors and Bro Grangers.
Bro. Barrett was not a member of any visible
church, be bad bis foible$ r and not free from
error, yet tbe writer bas, with pleasure, often
heard him, with tears in his eyes, relate bis
christi&D experience, which event occurred iu
the vear 1843.
While we mourn the death of Bro. Barrett,
let us Dot sorrow without hope. Hoping be
has gone to eDjny a life of peace and happiness
beyond tbe grave.
Resolved, That we tender to the widow of
tbe deceased our sympathy in her sad bereave
ment and a copy of these resolutions be seat
to her and also entered upon the minutes of
<>ur Grange with a request that a copy be sent
to tbe Southern Watchman for publication

of Athens. Case from Clarke.
1. Tbe municipal authorities of the city of
Athens have no power under its charter to es
tablisb and carry on a ferry across the Oconee
river, though it lie within the city limits.
2. Nor are the Mayor and Council in their
corporate capacity, liable to a passenger who
claims that his property was injured by the
negligence of the ferryman iu transporting it
over a ferry thus established without authori
ty of law. Judgment affirmed.
DIED,
In Gainesville, Ga., 5th of February, 1875, Mrs.
Jaw. Amur, widow of James Appleby, late of Jack
son county,deceased, iu tbo95th yearof borage. She
had been a consistent member of tho Presbyterian
ehureh for 65 years, most of the time at Toyatira
church, near Jefferson, Ga. For the last 65 years, she
resided on tbeir farm, 31 miles west of Jefferson,bav-
ing but recently movrd to (laine.-ville with her only
living daughter. Mrs. Bishop Seott. She leaves two
sons, J"ho and Hugh. Mr. John Appleby, tbe oldest
lives in LaFayette. Chambers county, Ala., and H. C.
Appleby, Esq., lives in Gainesville, Ga.
