gia Messenger between Col William Camming ot
Augusta, and Gen’l- Robort A Beall of Macon. It
appears that tho formor took some exception to nn

note to the latter who is one of the Editors of that

Sagacious Prediction.—In tho very firs/
Congress held under the Federal Constitu
tion, a discussion on Ihe Executive power
of removal lioni. office arose. The fol
lowing from the speech qf Mr Jackson, of
Georgia, delivered on that occasion, con
tains a prediction: which a recent occur
rence has almost verified to the letter.
“Mr. Jacltson asked, “was it politic to
place the oflicers of Government in such a
,situation as to deprive them of all their its -
dependence and firmness? Had not the
President the coutluand of the army and
would he nit have the Treasury under his
(humit The secretary of Finance would
not dare oppose him, and would leave him
unchecked to ctcrcite his powers.”

official paper if the administration, and

that the comm aiding officer at Fort Mitch
ell has been iujnurtcd to nfford to onr civ
il authorities', all proper facilities for putting
the case pf the killing of Hardeman Gwen
m a train lui legal investigation. The Cir
cuit Court of Alabama, for the county ol
Russell, is now in session, nnd a hill ol in

trators of that net, will ttUs day ho prepar
ed. iu pursuance of those instructions, I
have thought proper, fiOm n sense of duty,
lo ask at your bauds the aid requested ; and
in facilitate this object, dial the detach
ment of soldiers who wore present at the
killing of Owen he delivered over to die
Sheriff of this county. Tho reason why
this is dpumid necessary, is owing to lire
difficulty of ascertaining the name or names
of the person who committed die act, us no
one war present, it appears, but the file of
soldiers—or tins may be dispensed with if
you will be good enough tu furnish tho

P. S. Accompanied herewith, is the

drove named, and wished, to serve them.
His reply was “I’ll be damned if I give u;
■ man." After he had pot up his horsi
-md returned, the Major upon ascertaining
-lie papers were not to Utke the persons, bat
merely aubprrnas, affiant was permitted to
search the Fort, but could not find any one
of thorn. That lie. succeeded in serving
the subpoena on Lieut. David Manning
out of the Fort. He replied, “i shall not
go.” That on the 13th invt. a capias in
the nature of an attachment for contempt
of said court against the said Major Mein
tosh, was placed in my hands by the clerk
of said court; that lie again proceeded to
the For; and the place whom the Major
wns, mid told him he hail a capias to take
hint to court. He replied, “You shall not
touch me,” at the saute time saying lie hail
uot treated the court with contempt, and
that said court had nn authotily to take him.
That the reason ho did not .ittdnpt lo take
his person when ho had the capias was, be
cause it would have endangered his life by
so doing. That ho is satisfied any attempt
lie may nnko to serve process on said sol
diers, or upon the said M tjor will bo rusis
ted and provo useless. That the power
ol tlu country it insufficient lo exocute pro
cess on said porsoos, situated us they are
whir arms and protected by the Fort.
