ALTICLKS Ob' A TREATY.
Made at the city of Washington by Lewis

Art, 1. The creek iribe or /iidinn* cede
to the United Stoles ell tlieir land oust ol
the Mississippi river.
Art; 2. Tite L nitudStntes engage to sur
vey the said land, as soon as the same can bo
conveniently done, all* r tho ratification of
this treaty; and ivhen the snmo is surveyed,
moved at the expense of ihV United Sfitc-
and shall receive subsistence while upon
the journey, a id for one year after thoir
arrivals at their now homes. Provided,
however, that ihis article shall not be con
strued eo as to compel any creek Indian to
emigrate but they shall bo li ce to go or
stay, as they please.
Art, 13. There shall also be given to
each emigrating warrior a • tilts, moulds,
wiper and ammunition, and to each family
one blanket. Tliroo thousand dollars io bo

the creek tribe, to select one section, | shall be allowed, for the term ol twenty
and every other head of a Creek lamily to 1 years, lor teaching theit children. As soon

Art 3 I here tracts may be conveyed bv
the pO. soils selecting the same, to any per
son lor a lair consideration, in such man
ner, as the President may direct.-—The
contracts shall bo certified by some person
appointed for the purpose by the President
but shall not bevgffid till the President ap»
proves the same. A title shall bo given
by the United Slates on the compleliou ol
tho payment.
Art 4. At the end ol five yeais, all the
creeks entitled to these selections and de
sirous ol remaining shall receivo patents
therefor, in fee simple, from the United
States.
Art 5. All intruders upon the country
hereby ceded shall be re.i oved therefrom
iu the same manner as intruders may be re
moved by law from oilier public lauJ, until
the country is surveyed, and ilie selections
made; excepting, however, from this pro
vision, those while persons who have made
improvement* aud nof expelled ih« Creeks
fror/i theirs, such persons may remain till
their crops are gathered. Alter the coun

Art io. Twenty nine sections, iu addition

Art, 7, All the locations authorized by
this treaty, with the exception of that to
Benjamin Marshall, shall be made in con
formity with the lines of/tie surveys; and
the Creeks relinquish ail claim lor im
provements.
Art. 8. An additional annuity of twelve
thousand doilais shull be paid to me creeks
for the term ol live years, and thereafter

thousand dollm s, and shall he paid Inr tile
term of fifteen years. All the amimties due
to the Creeks shall be paid io such u man
ner as the tribe may direct.
Art. 9. Foi the purpose of paying cer-
taui deles due by me Cteeks, and to relieve
them in their presbii/ distressed condition,
the sum of one hundred thousand doll .rs
shall be paid to the Creek tribe, us soon is

tribuled as they may direct, and wli cli
shall be iu lull consideration of all improve
ments.
Ait. 14. The cie. k country west of the
Mississippi shall bn solemnly guarantied tu
the Cteek Indians, nor shall any State or
Territory, over have a right lo pnss laws
for the government of such Indians, but
they shall be allowed to govern themselves
so far as may he compatible with the gen
eral jurisdiction which congress inny think
proper to exercise over them. And the
United States Will also defend them from
the unjust hostilities of other Indians, and
will also, as soon as the boundaries of the
country west of the Mississippi are ascer
tained causo a patent or grant to bo exe
cuted Id the Creek iribe, agreeably to the
third section of the act of congress of stay
2d 1820, entitled “An net to provide for
an exchange of lands with the Indians resi
ding in any ofilio States or Teiritories, and
for their removal west of tho Mississippi.”
Art. 13 This treaty shall bo obligatory
