Sam retorted to n variety of means to

otbur sharp aud powerful condiments—
pushing them to such au extent that his
mouth burnr like fire, and his eyes w.tiOred

Sam now pulled off his gentleman’s coat,

Tuscaloosa, 20th Dec. ^833.
With my annual message of the 13th u! *
I transmitted to/ho Genornl Assembly, sun
dry documents,; which had been received
from (ho Honorable P, T. Harris, shoving
that the persona indicted for the murder of
Hardeman Owon, Here protected by iho
commanding officer at Fort Mitchell, arid
that hb hud placed at defiance tho offlcei
nnd process of the Circuit Court of Russell
county. '
I did not believe that tho President would
sanction this conduct, arid in this opinion (
have not been disappointed; lor, on tlio re
ceipt of my'letter at tho War Department,
of the 26tlr September, orders were - issued
to Majoi McIntosh to submit to civil pie-
cess, and Id affoid every facility for its due
nud proper execution. This Will bo mote
fiully perceived from tho letter of the Sec-
relarp of war of——November, and thd
documents tvhicif accompanied it, which
nre herewith sent, for /ho examination of
tlio Legislature.
Francis S. Key, Esq. ngemloman equal
ly distinguished for intelligence arid for hi*
frank nnd honorable charac/er, arrived at
Tuscaloosa, at an early period of the pres
ent session, with instruction! to dotrtmuni-
cate, fully the views of /lie President in
relation to-the settlors in tlio Creek conn-
Zry.
With Mr. Key I have had several eott*
versa (ions the sabs/ance of which is con-
taint-d iu his let/er of the 16th mst, in an
swer to a note from me of tlio tamo dato.
Copies of tliis correspondence are herowith
laid before tho General Assembly; from
which it will bo seen, that the settlors aro
to reiiinin in tiie undisturbed possession of
tlioir improvements, and thot llto orders of
the Secretary of War are lo bo confined
'exclusively to tho locations which were re
served for tlio Inflians by llto treaty.
Thu principal object of this unpleasant
controversy with the General government
boini' obtained, by asserting and vindicating
those great principles, #hich Were estab
lished hy the Constitution, for the securi
ty of tlio people, and for tho protoction of
tlio States, in exercise of (hair righlful juris-
diction, 1/ cannot fait to be ft source of tba
highest satisfaction to on* (cilow citizens
in*those now counties, that tho calamity
with which, at one period, they were three,
tened, has bnou averted, aud of prtdu uud
patriotic t*uliaiion to our people* every
wlieru,, that the supremacy oftlio civil over
'he military authoiity has been successful
ly maintained.
It is believed that the plan which has
been adopted by tho General Government
and the exertion* they are making to pur-
c ate the resetvations, will effectually
prevent any future collision. Wow >-r
