The issue is made up in South Carolina.
The Conservasives of the State in convention
assembled have decided that it is inexpedient to
make a nomination, and have endorsed the nom
inees of the independent Republicans—Greene
and Delaney.
Trammell has withdrawn fgom the contest
in the Seventh Congressional District. The Ex
ecutive Committee has called a meeting for the
19th.
At a recent meeting’ of the Democracy of,
Oglethorpe county, it wus determined that the
representatives from that county in the next
Legislature be instructad to vote for the call
fora Constitutional Convention.
Jerome Bonaparte, the second son of tiie de
ceased A neiican nephew of the first Napoleon,
was recently admitted to tin bar at Baltimore,
and his first plea is prououneed to have been an
admirable effort. He is described as a fine
looking j oung man cf grave aspect, with an
admirably formed head and a face full of intel
lectual expression.
The Elmira Advertiser says : Henry B Fitch,
of this city, contemplates a monument to the
memory of the Confederate Jdead who d ; ed in
prison here during the war, to be placed at
Woodland Cemetery, in this city. It is to bo of
aitificial stone, twenty feet high, a single shaft
supported by a plinth, base and sub-oase, not
possessing much, if any, ornamention, but being
of.graceful proportions and noticeable on many
accounts. On one face are the inscriptions
“Rcquiescat in Pace, “1874," “Erected by a Un
ion Officer, in Memory of the Confederate Dead ’’
Pardoned—John Gorman, convicted at the
January term, 1869, of Richmond superior court,
of the offense of assault with intent to murder,
■and sentenc.d to ten years in the penitentiary.
Good deportment without exception since con
finement was the principal ground for clemency.
At a meeting of the representative col.red
people in Louisiana, Thursday, an address was
>ssu ed denunciatory of the Kellogg usurpation
and declaring that they cherish no animosity to
ward the white race and favoring a general
turning over of political affairs both State and
municipal.
G. B. Lamar did in New York on the sth
inst It will l>e remembered that he recovered
a cotton claim not long ago, amounting to $579,-
000 out of which he had to pay Ben. Butler
s2r-;000, and other attorneys §07,000. He left
Vy his will, among other bequests, the sum of

for indigent negroes in the city ot Savannah,Ga.
A shooting affray occurred in CuJibcrt, elec
tion day, between George Oliver, of Ward’s Sta
tion, and Joeu Hay, a farmer living near Cuth
bert, in which Hay was killed and Oliver woun
ded in three places, not seriously. Two out
siders, a white man and a negro, were wound
ed in the melee. It occurred in front of the
Brooks Hotel.
Experiments recently made in England indi
cate that wagons are most easily drawn, on all
kinds af roads, when the fore and hind wheels
are of the same size, and when the polo lies
lower tuan the axle.—N. Y- Tribune.
Garibaldi, who gave Sicily to the Kingdom of
Italy, is said to be in such very poor circum
stances as to he often without the means of
procuring the necessaries of life. A sum of
money sent him recently by an admirer, from
Toronto, Canada, was accepted by the ex-chief
tain of the red shirts with grateful thanks.
While Northern woolen-mills are stopped,
those of Georgia are increasing, the number of
looms and reaping dividends. Columbus has
350,000 spindles, GO woolen and 870 cotton
looms, all built in less than seven years by a
city which lost 60,000 bales of cotton, worth
fifteen million dollars, and millions of other
property.
The Hot). 15. Gratz Brown, of Missouri, has
written a long and brilliant letter formerly an
nouncing his purpose to support the Democratic
ticket in that State and assigning his reason
therefor. Gov. Brown very justly says that the
so-called People’s Pet ty is but Republicanism in
disguise, and he warns his readers against be
ing entrapped by any such snare.
The Valdosta Times says some unknown per
son entered the Ordinary’s office tho night be
fore the election and carried off the tax books-
We suppose it was done for the purpose of
preventing the payment of taxes on the day of
election, t.s they were found deposited at the
Court-house door at day-light yesterday morn

The City Council of Atlanta has refused to

Southern Outrages.
A correspondent of the Chicago Inter
Ocean confidentially stated what he had
been sent South for, a few days ago, to
a citizen of Vicksburg. If we had such
a tiling as ku-klux in the South the most
severe treatment would be too mild for
these infamous scoundrels: '‘You see,
I’ve been sent South to represent things
in accordance with the line of argument
held by the Inter-Ocean. The time for
the fall elections is now upon us, or soon
will be, and my paper is making a strong
point for wavering Republicans by
showing the South to be in a state bor
dering almost on civil war. We must
represent that it will bo dangerous for
the Democracy in the North to succeed ;
for, being in sympathy with the South,
the negro will be annihilated if they
win. We must keep Democracy down
by showing a terrible state of affairs in
the South, where they happen to be in
the ascendency, or where they feel they
are gaining strength. Don’t you see ?
“Southern Outrages” makes a big point
for Northern Republicans; it keeps them
more closely united. And don’t you
know that to shoot one nigger in the
South makes forty Republican votes ?
That’s the idea. Now, I’m a Democrat
(between you and me) ; but I am work
ing for bread and meat. You know how
that is yourself. Since I came to Vi ks
burg, I’ve found everything nice and
quiet, and really I cannot, if I felt in
(lined, say anything else; but I presume
I’ll have to do it. That’s the policy of
the Inter-Ocean. I find- no ostracism
here. I have interviewed Capt. Fred
Speed, Capt. John Beard, and many
others ; and though they are Northern
men and Republicans, they tell me they
have long been disgusted with the vil
lainies of men high in office in this State
and are now members of the people’s
party.
An old army officer who signs himself
“Assistant Adjutant General,’’ in writing
to the Chicago Tribune, casts all blame
for existing troubles between the North
and South on the politicians. He says
there is no disagreement or want of re
spect between tire soldiers who fought
each other through the late unpleasant
ness. They never fight over their bat
tles in anger, but meet each other with
words of pleasant cheer.
True. The most warlike of the mass
es are those who did not have a chance
to sacrifice themselves upon the altar
of their country in the late war. Their
blood thirstiness is really startling.
Never think of reasoning with a mule,
whether it has four or two legs.

Warner, C. J.—This case came before the
cour. below on a certiorari from ajustice’s court.
The plaintiffs sued the defendant on a promisso
ry note for $30.00, payable to the plaintiffs four
mont's after date for value received The de
fendant offered in evidence (over the objection
of the plaintiffs) that the note was given for a
sewing machine, and that the plaintiffs’ agent
agreed at the time the not was given that if
the machine .did not give satisfaction to his wife
that he, the agent, would taxe it back at any
time within six months, the agent saying that
his time would soon be out, that he wanted the
note so as to enable him to get his commissions
for selling the machine.
The justice held that the parol evidence was
admissible, and the court below sustained the
ruling of the justice and dismissed the cei tiorari,
whereupon the plaintiff's excepted. Was the pa
rol evidence admissible for the purpose of prov
ing a condition to the contract not expressed in
the lace ot the note? The written contract was
a promise to pay the plaintiff’s thirty dollars for
value received without any conditions whatever.
The defendant proposed to prove, aui was al
lowed to drove that his absolute, unconditional
promise in writing to pay the plaintiffs thirty I
dollars, was made oil condition that if a certain
sewing machine, for which he alleges the note
was given, did not give satisfaction to his wife,
that the plaintiff would take it back. The gen
eral rule is that contemporaneous evidence is in
admissible to contradict or vary the terms of a
valid written instrument. New Code, 3400. I’arol
evidem e is inadmissible to add to, take from, or
vary the written contract New Code, 2754.
There is no ambiguity on tho face of the note,
latent or patent, nor does it appear that any
part ot the contract was omitted Horn the note
by fraud, accident, or mistake. If the contract
was conditional, as the defendant now seeks to
prove by parol, then it should have been inserted
in the note. There is no pretence that the de
fendant did not know the contents of the paper
which he signed, or that only a part of the con
tract was reduced to writing, by fraud, accident,
or mistake. The contract which he signed was
an unconditional promise to pay the plaintiffs
thirty 7 dollars, and that written promise of the
defendant is the highest and best evidence of
the contract. Dester vs. Fowler, 43 Ga. Rep ,
190 Sullivan vs. Cotton States Life Insurance
Cos., 43 Ga. Rep., 423. The rule which excludes
parol evidence from adding to, or taking from,
or varying written contracts, in view of our ev
idences, Act which allows parties to testify in
their own favor should not be relaxed. This
case does not come within that class of cases
when receipts or notes li ave been given in settle
ment of a former indebtedness which are sub
ject to explanation.
Let the. judgment of the court below be reversed.
