months after the date thereof he promised
to pay said petitioner or bearer, three
hundred and ten dollars for value, receiv
ed, and that afterwards, on the dav and
year aforesaid, tho said Robert F. Mc-
Kinney the better to secure the payment
of said promissory note, executed and de
livered to said petitioner his Deed of
Mortgage whereby he conveyed to said ,

The petition of Harrison 'V. Jiiley ’
sheweth that heretofore, to-wit, on the ;
15th of Jpril 1861, Walter B 6'mith,
then of said county, made and delivered
to your petitioner his certain instrument
in writing called a promissory, whereby '
he promised on or by the second day ’
of May next thereafter, to pay your peti-i
tioner or beare.-, one thousand and eighty-[
four dollars and 71-100 dollars for value
received- And for the better securing the 1
payment of said note, on the day and
year aforesaid the said Walter B Smith
executed and delivered to your petitioner '
his certain deed of mortgage, conveying
to your petitioner the undivided two
thirds of lot of land No. one thousand and
fifty-one (1051) in the 12th district and )
Ist section, and lot No 1221, 1222, and
the undivided half of Lot No. 1155, in
the 11th district and 1 section of said
county of Lumpkin, conditioned to be
void upon the payment of the promisso- (
ry note aforesaid, (which note and deed
of mortage are here to the Court to be
shown). Yet your petitoner avers that
said Walter B Smith, although so indebt
ed, and to pay said note often requested,’
hath not paid said note or any part there- 1

fused, and yet refuses, wherefore your;
petitioner prays that such rule order may j .

ty with the stitutes in such cases made ,
