MUSCOGEE COUNTV. ] WILL be sold on ihe first Tuesday inDECEM- j BER, at the market house in the City oi Co- r luiubus, between the usual hours of sale, the following property to wit: All that portion of half acre lot number one hund red and seventy-five, fronting on Randolph street sev enty feet, and en Broad street one hundred and forty seven feet ten inches ; being the houses now occupied by L. J Dav.es, Walker, Clapp, Nolen Hall At De blois and others. Also, part of lots one hundred and seventy-five, and one hundred seventy-six; each con taining twenty-four feet front, on Randolph st. north Ade, and running back one hundred and forty-seven feet ten inches, more or less. Upon which is erected two brick stores, at the time of this mortgage occupi ed by B. A. Sorsby, and Read & Talbot. Also, that part of lot hav.ng upon it two brick stores on the south side of Randolph street, between Oglethorpe and Broad streets, at the date of tins mortgage occupied by Boon, Boring, & Cos., and Mr. Smith. Also, half acre lots numbers (35, 3G, 37 and 38) thirty-five thirty six, thirtv-seven, and thirty-eight, 1 hese four lots being the late residence of the defendant. Also half acre lots (229, and 230) numbers wo hundred and twenty-nine, and two hundred and thirty, and part of. half acre lots (227, and 228) numbers two bund led and twenty-seven, and two hundred and twen ty-eight. This last named properly is known as the Oglethorpe Hotel pioperty, and fronts one hund red and seventy-four feet ten inches on Oglethorpe st. and runs directly east to Jackson street. All the above property is levied on under and by virtue of a mortgage fi. fa. issued from the Superior Court us Muscogee county, in favor of Edmund Molyneux, Jr. vs. James S. Calhoun. Properly pointed out and de scribed in said mortgage fi. fa. Also, the following property to wit: Half acre lots in the city of Columbus, numbers, 128. 298, 299, 300, 301, 302, 422, 423, 421, 425. 426, 427, 428, 429, 430, 471,474, 475, 223, 184. Also lois numbers 138, and 140, on the Coweta reserve, each containing one hund red arces ; and one half of lot number 57, containing fif ty acres ; and lot of land number 22. in the 9th district < f Muscogee county, containing 202$ acres more or less. Also, half acre lots numbers 39 and 193 in the city of Columbus, and 55 by 131 feet, being a part of lot numb’ r and the interest of James S. Calhoun in lot number 271. Also 8 dozon bottles of wine, (more or less) 3 decanters 1 freezer, 4 jelly moulds, 1 stew pan. 1 sett scales and weights, 4 lamps, 1 stair carpet, 6 carpets, 1 passage carpet, (oil cloth) 3rugs, 1 crumS carpet, I table, and a lot of kitchen furniture. All the above half acre parts of lots lie in the city of Columbus and county of Muscgee, Georgia, and tho whole of the above property is levied on as the property of James S. Calhoun, to satisfy sundry fi. fas. from Muscogee Superior Court, in favor of Burton Hepburn, the Insurance Bank of Columbus and others, vs. James S. Calhoun, and Calhoun and Bass. Id ; Clara, a woman 30 years old ; Lucy, a woman 30 years old; Judy, a woman 60 years old; Catharine, a wo man 25 years oid ; Hubbard, a child. 1 year old ; Nan cy a girl 7 years old ; Caroline, a girl 3 years old ; Su san a girl 11 years old ; Charlotte a girl 11 years old. All the above negroes are levied on as the property of Benjamin Edmunds, to satisfy the following fi. fas: one in favor of John Odom vs. Benjamin Edmnnds, .(maker) one in favor of Thomas C. Evans, for the u e .of John Odom, senior, vs. Benjamin Edmunds, and the other in favor of Jno. Odom vs. Benj. Edmunds. Also three negro slaves, to-wit : Malinda a wo man about twenty-one years of age, and her two chil dren, Dennis a boy about five years old, Frances a girl about two years old, and four horses aud one mule, one yoke of oxen and wagon, five cows and calves, fortv-’vvo head of hogs and live feather beds, bedsteads and furniture, together with all and singular the house hold and kitchen furniture of the said James Ennis, together with all the crops of the said James Emus, annually, (till paid) to have and to hold the said bat gained land and premises and property to (the said Gabriel Jones) your petitioner, his heirs and assigns to iiis and their own proper use aud benefit and be hoof forever, and the said Janies Ennis lor himself, his heirs, executors and administrators, the said bar gained premise and properly, unto your petiuoner dtd warrant against the claim of himself and Ins heirs and against the claim of all other persons, whatever, with a provision, nevertheless, that if the said Janie- Emiis, his heiis, executors and administrators, should and did well and truly pay or’ cause to be paid unto your petitioner, his heirs and assigns, the aforemen tioned sums of money in said notes specified, accor ding to the tenor and effect then of. on the days and tiin s mentioned and appointed for the pav ntent there- 1 of, in the said promissory notes mentionid. with law ful interest for the same, according to the tenor of said notes, then and from thenceforth, as well the said mortgage deed and the right of property thereby con veyed. as the said promissory notes should cease, de termine and be void to all intents and purposes. Now this petition shewelh to the court that the first and se cond promissory notes heretofore specified, to wit: the note due on or “b- fore the first day of January next en suing, the date of said mortgage deed, and’ the note due on or before the first day of January next, ensu ing, the date of said mortgage deed, and the note due on or before the first day ol January eighteen hundred and forty-one, with interest on each, have long since been due and payable (as aforesaid) but that neither the said James Ennis nor any person or persons on his behalf have paid the said sums of money therein specified, or any part thereof, but has hitherto wholly and entirely failed and refused so to do—wherefore your petitioner prays that the said James Ennis be ordered by the court to pay into the Clerk’s Office of the same on or before the first day of the next Term thereof, the said sums of money in the last aforesaid two promissory notes specified, together with ail in terest and cost which may be due thereon, at the time of such payment, or that in default thereof, bv the said James Ennis the Equity of Redemption of the said James Ennis in and to said mortgaged lots of lands, be thenceforth forever barred and foreclosed.
