IT being represented to the court tlmt Joel
King and'Henry Snellings, Executors of John
King were lately possessed'of six promissory
notes, each made by Robert Horton and James
Paiillo, each bearing date on the fourth day of
February, eighteen hundred and thirty nine, and
due on the twehty-fifth day of December next,
after the date thereof, five of which were for
thirty dollars each, antl'ofce for twenty three dol
lars, and that said notes” have been lost or de
stroyed. It is therefore, ordered, by the court,
That said Robert Horton and James Patillo dr
show cause, on the first day of the next term of
this court, why copies of said notes should not
be’ established in lieu of said original notes lost
as aforesaid.’
And it appearing to the court, said Robert
Horton resides without th'c limits of this State.
It is thereftire,’ ordered, that service be perfected
on him by publicationuffhis Rule Ni Si for the
space of three months before the next term of
this court, and that said Patillo be served with
a copy of this Rule at least three months before
the next term of this'eourt.
