TIIE FIRST ARTICLE OF TUB CONSTITUTION
OF THE STATE.

in accordance with U.e requiremsatsof Urn Constitu
tion of this State, the following shall lie adopted in lieu
of the said seventh section Each county of this
State shaft have one Representative, and no .county
shall have more than two Representatives. Thirty-
seven counties having tlie greatest population, count
ing all tree white persons and three-fiuhs of the people
of color, shall have two r Repreaentatives—and if any
new county shall bo hereafter formed, said new county
shall be entitled to one Representative, and the appor
tionment shaft be made the General Assemhly at the
session at which this section shall be adopted as an
alteration of the Constitution bv an aetto be introduced
after the adoption thereof, and a new apportionment
shall be made at the session next after each future
enumeration of the inhabitants of this State, made un
der the Constitution and laws thereof, but at no other

For the^purpose of tho better securing the payment
of a certain promissory note, bearing even date with
said mortgage deed, made by tlie said Reuben Thorn
ton and Benjamin T. Smith, payable twelve months
sifter date, to the said James Saye.or order, lor tho
sum of twenty-five hundred doilara, with interest from
the date thereof, and afterwards endorsed by tho said
James Stye, and delivered to one Richard Banks, and
fortlie saving the said James Saye harmless from the
said endorsement. - •
Which said deed of mortgage had a provision there-
contained, to tiie effect tollowing, to wit: that if
e said Reube n Thornton or Benjamin T. Smith,
their heirs, executors and administrators, should well
and truly pay, or cause to bo paid onto tlie said Ricliard
Banks, or his assigns, the aforementioned aura of
twenty-five hundred dollars, with the interest as afore
said, and all costs that might accrue tliereon, so as en
tirely to exonerate the said James Sayo from any dam
age or further liability by virtue of his endorsement as
aforesaid, then and from thenceforth tlie said deed of
mortgage, as well as the right to the property thereby
conveyed, and also the said promissory note, should
cease, determine, and be void, to all intents and purpo
ses, otherwise to remain in full force and virtue; and
also, tliat tho said deed of mortgage might be foreclcs-
ed by the said Jaines, according to law.
And your petitioner avers, that afterwards, to wit,
the said James Saye, to whom, or to whose assigns tho
.-aid mortgage was as aforesaid, made, executed ami
delivered, by his v. r.ttcn transfer on the back of said
j mortgage, dated the eighth day of April, 1843,
; and fora valuable consideration, transferred and deliv-
l ered said deed of mortgage to your petitioner.
