POETRY.
From the Charleston Courier.
The following is from the pen of a friend, who
has resided, for many months past, in the
Island of Cuba:
BAVAN
Near the Plaza de Armas, is a tree still in
rigor, said to be tiie identical tree that Colon
(commonly called Colcmbcs) and his follow
ers rested under, on their landing in Cuba.
Close by, also, on the top of a turret, is the
figure of an Indian Queen, whose haughtiness
and vanity, for charms she did, or deemed she
possessed, obtained her the appellation of Ha!
Vana! (ah! vain! or perhaps more meaning
ly, Vain One !) It is probable the aptness of
savages to catch new sounds, made this a
tJtenmon expression—and when the town was
built, caused the name of Havana to be given
to it.
The bark lay sleeping on the wave,
Its guides on land bad laid,
From mid-day’s sch'ircldng sun, beneath
A spreading C-yba’s* shade.
Th. y iirst bad knelt, and in the name
Os him who led them un to fame,
Claim’d the wide stretch of land, it Isles
That farther to the westward lay;
S, read Spain’s broad ban ner to the breeze
And blest the God who led their way.
That tree in lonely grandeur stood,
Whose shade they lay beneath ;
Around —save rock, ami here and there
A hillock —was a heath, —
Hut in the distance there w as seen,
The Plantain and the Palm,

When other leaves are calm.
And farther in the distant w ood,
Were trees hat ages there had stood.
Gut hut nOr culture met the eye,
Tho’ every thing looked bright and fair,
As if —from Ait’s dominion free,
Nature herself had tended there.
Birds of the brightest plumage flew,
At times across the forest view ;
<Save .hnn —nought living but the group
Ol stranger wanderers were seen ;
And it was alien., still and lone,
As tho’ no other there had been.
Sleep had its soft oblivion spread,
o’er;ill of them but one ;
Whose eyis shed out their pu reing rays,
Bright as the mid-day sun :
His form was such, that well might hold,
A soul that wonders could unfold.
He glow’d in boldest beauty there ;
liis lip a heavenly smile bad curl’d;
Seeming, instead ofbaving found,
Hud spoken, and bad made a world.
’T'vas colon ! —he whose spacious mind
Had seen—e’en ’mid tin jeers
Qf ignorant doubts—and triumph’d o’er
His rude companions fears.
He, who, when ocean seem’d to be
The confines of eternity,
Had dared to vemure, and with crew,
That scarce übedi nt to his word,
Seem’d only ripi for mutiny,
’Till the rapt cry of “laud” w as heard.
He who knelt down and kiss’d the ground,
H ■, only he, had ever found;
And praising God for having sent
Tiie ligh’, ius genius only saw,
I’lanU‘d the Cross—Spain’s banner spread,
And called ihe Isle, San Salvador.
And tins was he ! —who still iiiienu,
To seek the wide w orld’s bound,
Another gem had given Spain-
Had Cuba's Island fuund.
The sun had set, and twilight’s veil,
Was shading o’er the view,
W hen near to colon's veut’rous band,
A tribe ofindiuuß drew.
They had conic from ihe wood, and seen
The stranger garb—the stranger mien—
The monster that had brought them there,
The waves so lightly bore ;
They had seen much, but such as these,
Had never met before.
But free from fear, and from mistrust,
They only come to see,
In simplest thought, and kindest wish,
What strange shapes they could be.
Foremost of all, an Indian ranid,
In natuie’s fairest gar!) array’d ;
Sea shells, and leathers that would vie
In beauty with the rainbow’s hue ;
And flowers, bright and fresh as when
The sun’s ray kiss’d from them the dew.
She came as Princess of the Isle,
With haughty step, but ’witching smile ;
Which told, that even here met,
Charms that could bliss or pain impart—
Which told, that woman even i.erc,
Could smile and triumph o’er the heart.
Ha! Vana! from great colon broke;
While gazing on the Indian queen ;
Ha! Vana ! too, his followers cried,
Struck witn tier conquelry of mien.
Still lives that tree—still docs it shade,
The place where colon’s form has laid ;
But round it, now a City stands,
And Art has taken Nature’s pl ace-
Save this tune tree, there is not aught
Os former wildness you can trace :
Havana, it is called—but few
Who see the tree, or view the town,
Tliink of the haughty Indian queen,
Or colon’s past renown

* Ceba, or Cotton Tree. It grows high,
and the branches spread out from the top, giv
ing great shade. The trunk is frequently two
yards in circumference —it bears a species of
Cotton, I tliink every third year.
1 The Cocoa, and indeed tiie Palm and
Plantain also, having very long leaves, art
easily shaken and produce a sighing noise al
most continually ; with a breeze, it sounds
like the resiling of waters.

hune, stating that Elisha W. Brewer, in
his life time executed a bon for titles to your
petitioner, the said Terhune, to make a good
and warrantee title to a certain lot of land, in
the Town of Monticello, described in said
bond, a copy of which is berew ith annexed :
And it appearing to the Court, that the said
E. W. Brewer has departed this life, without
executing titles to said lot, and also, that John
>C. Gibson, and Mary Brewer are Adminis
trators of said E. W. Brewer —
It is therefore ordered, That unless cause
be shewn to the contrary, on or lit fore the Ist
Monday in January next, the Court will di
rect the Administrators to make titles unto
the said Terhune to said lot of land, in pur
suance of the laws in such cases made and

IT appearing to the Court, upon the petition
of Thomas Whitehead, that James Stew
art, with Silvanus Stewart and Irvin Lawson,
his securities, executed a bond to the said
Whitehead, (a copy of which bond is annexed
to said petition) on the ninth day of May,
eighteen hundred and twenty-two, to make a
title to the said Whitehead, to a lot of land,
number one hundred and twenty-nine, in the
eleventh district of Hall county, in said state
—and it further appears, that the said James
Stewart died without having executed said
titles.
It is therefore ordered, That Silvanus Stew
art, and Irvin Lawson, the administrators of
the said James Stewart, do make a good and
sufficient title to the said Thomas W itehead,
to the said tract of land, unless cause be shewn
to the contrary, on or before the next January
term of this Court; and that a copy of this
Rule be published in one of the public Ga
zettes of this state for three months.

A times called, TOLIVER KIMBAL was
permitted to accompany my waggon, loaded
with 8 baggs of Cotton and driven by my ne
gro man, to Augusta —when on its arrival
there, which was on or about tiie 10th inst.
he assumed the ownership of the Cotton which
he sold, and pocketed the money : He also
took from my team a fine sorrel MARE, with
white feet and a blaze in her face, and brand
ed on the left shoulder with J. D. ; a half
worn saddle and bridle, with plated or washed
stirrups & bits, and has absconded to parts
unknown.
Said Dawson was raised in Green county
Tennessee, and is about 21 years old, about
6 feet high, black eyes hair and beard, with a
small scar on one of his cheeks, occasioned
by a scratch. His professed business to Au
gusta was to obtain a situation in a store as a
i lerk —but I have since learned, that he is a
professed gambler. He had on when tie left
my house, a brow n coat and plaid cloak—
other articles of clouthing not recollected.
He will probably change his cloathing, as I
have learned that he bought a suit of cloaths
in Augusta.

about 21 or 22 years of age, 4 feet 9 inches
high, who says he belongs to Daniel Nelson,
of Autauga county, Alabama. Th# ow ner is
