RECAPITULATION
The law is still in force so far as
respects Physicians, practicing with
out a Diploma, and Apothecaries and
Druggists, as will be seen by the fol
lowing extracts from the Code of
Georgia:
Sec. 1402 of Code—Penalty for un
authorized Practice :
Any person who shall practice Sur
gery or in any mannerprescribeforthe
cure of diseases for fee or reward in viola
tion of the provisions of this Chapter,
shall be liable to indictment, and on
conviction shall be fined, not exceeding
five hundred dollars for the first of
fence, and for the second, imprison
ment, not more than two months, one
half of the fine to inure to the in
former, the other half to the education
al fund of the county.”
Sec. 1407—Druggists must obtain
License.
'No person in this State shall open
or keep a Drug or Apothecary Store,
without first obtaining a license there
for, from the Medical Board of his own
School. Such license shall be record
ed in the office of tbe Ordinary who
is required to keep a list of the names
of the persons licensed in a conspicu
ous place iu his office, for which he
shall receive one dollar fee, for each
license so recorded.”
Sec. 1408—Druggist indicted must
show his authority.
‘Any person violating the preceed-
ing Section is liable to indictment, and
on conviction, to be fined not less
than one thousand nor more than five
thousand dollars, and for a continua
tion after said conviction, to the like
fine, and imprisonment not exceeding
six months. The onus of proof is
upon the defendant, to show his au
thority.”
The above law will be enforced by
the Board.
At the last session of the General
Assembly of Georgia, paragraph 1st,
of Section 1396, of Irwin’s Code, was
repealed, and therefore, a Diploma
from an lncorporatedMedical College,
is sufficient authority to practice Med
icine and Surgery, without a license
from this Board.
Non-Graduates, Druggists and A-
pothecaries, are still amenable to the
Law, and must procure a license from
this Board, if of the Allopathic School.
A diploma from a Medical College,
does not authorize the holder to com
pound and sell medicines.
The Board will continue in session
until July 1st, next, to afford all, who
desire it, an opportunity of procuring
such legal*license.
