United States District Conrt for SontUern DistrictAtfuSggS? Hon. John Ebshne, Judge, Presiding. The District Court opened at ten o’clock yesterday morning. The Court proceeded to the consideration of cases of bankruptcy: In the case of Benjamin Smith, of Albany tried at the last session of the Court, and in which the jury rendered a verdict that he was a bankrupt, a new trial was granted, and the case came up yesterday. Smith was brought into Court on the petition of H. B. Claflin & Co., lor involuntary bankruptcy. The case was again tried and submitted to the jury, who, after considering for some time, were miable to agree, and reported a miss-trial. “■ .P-™* 58 for petitioners; Strozier & Smith for defence. Atlanta, October 27, 18G8. ) Motion Payton, Esq-, Savannah, 6a: Dear Sib : In reply to the' first inquiry in your esteemed favor of the 23d inst., I would say that I believe an act, or bill, did pass both Houses of the General Assembly at its late session, to authorize the holding of an elec tion throughout the State, in January next, for one Justice of the Peace in each district G. M.; but it did not receive the sanction bf the Governor, and, therefore, did not become a law. As to your next inquiry “ if Sec. 475 of the Code of Georgia is in force,” I most say it is not, only so far as not changed by Sec. 3 of the 14th Art. of the Amendment to the Con stitution of the United States, which is in these words: “3. No person shall be a Senator or Rep resentative in Congress, or Elector or Presi dent, or Vice President, orjiold any office, civil or military, under the United States, or under any State, -who, having previously taken an oath as a member of Congress, or as an offi cer of the United States-, -or as a member of any State Legislature, or as an Executive or Judicial officer of any Stale, to .support the Constitution of the United States, shall have tion to such matters. TheIscbease of Pay to the Police.—There appears to be a hitch in the proposed increase of ten dollars per month to the privates of the police force. The ordinance provides for an increase, in the same ratio, to the officers, to which some of the members of Council are opposed. The placing of the jail guard on the same footing with the police is also re garded unfavorably. So, at the last meeting of Council the ordinance providing for an in crease of pay was laid over until Council could think about and consider the matter further. If Council would stop paying nineteen or twenty thousand dollars per year for not hav ing the streets lighted, invest part of the sum in kerosene lamps and oil ana the remainder in paying for the services of a sufficient num ber of men to strengthen the police force and Bjake 0 more efficient,’ 1 ifwotfld be acting sensibly. ■ „ Bankbuptcy.—In the Clerk’s office of the United States District Court, Southern Dis trict of Georgia, yesterday, petitions asking to he adjudged bankrupts were filed, from Striped do Fancy do Yarns, Ass’t Nos...
