Hardcnstle, a dealer in themarket, charged] with having committed an'assanlt and battery* upon A Kowe Cullens. The evidence' was beard, and case argued by Hon.' R: E. Lector fur defence, and General Henry B. Jackson for prosecution. The jury returned a verdict of “not guilty,’’ia favor of defendant, and that the prosecution was malicions, and the. prosecutor should pay costs. John Burney, colored, was charged with an assault and battery. He was tried by jury, aud the evidence for plaintiff was heard by the Judge. One of the witnesses swore that the affair occurred on . a dark and -stormy night, when it was impossible to see any thing; and that she saw the defendant, reoog- nized him, and described the manner in which he was dressed! The case was con- tinned over, and the Court adjourned until four o’clock thia afternoou. The stroke oar of the Fairy broke at toe first pull, but toe oarsman caught hold of toe :next, and two men polled on the one oar. The boats kept close together, there being no perceptible advance made toy any for a few minutes.- Pulling against the tide bronght out the muscle of the oarsmen,, and they worked with a will to. take the lead. The-. Kate Stewart was the first to shout ahead, tout did not quite clear herself of competitors for a long distance.
