THIRTY-FIRST CONGRESS
SECOND SESSION.
In Senate February 23.
After some unimportant business—on mo
tion of Mr. Atherton, the Senate resumed
the consideration of the Ciril and Diplomatic
Appropriation bill, and Mr. Dayton submitted
his amendment, providing for a civil and mill
tary government in California, which was yes
terday ordered to be printed.
Mr. D. addressed the Senate at length, in
support ol his amendments. He had been in
clined to favor the proposition of the Senator
from Wisconsin, (Mr. Walker.) when it was i
first submitted ; but, after reflection, he thought
the practice in such cases hitherto should now
be adopted. No territorial bill, he conceived,
could pass the House, without the peculiar
proviso which would render its passage here
impossible; or if possible, judging from the
previous acts of the executive, could not be
co me a law.
His proposition was essentially the same, he
said, as that of the Senator from Massachu
setts, (Mr. Webster,) except that the latter did
not extend the revenue laws over the territory,
a provision indispensably necessary.
In taking the law relating to Florida and Lou
isiana as his copy, he had erased the prohibition
of the African slave-trade, because it was use
less, being now provided against by other laws.
He referred to the manner in which Louis
iana and Florida had been acquired, to show
the similarity of those cases with the present.
The latter had been governed under this law
for three years, and the former for one year,
previous to the establishment in either of terri
torial government. These were established
precedents, known and acted upon in times
past, and he could perceive no reason to depart
from them in the present case, and hazard either
State or Territorial governments.
The governmentvvhich his propasition would
provide was the very kind of government now
needed in California, and which would be need
ed for a year or tw o to come. They needed
there the strong arm of the government. It
had been said that there had gone there the off
scourings of the earth and the skiinmings of the
sea, and it required a government strong
enough to keep it in order.
If Gen. Jackson were now in power, clothed
with the power with which this bill proposes
to clothe the President, he had no doubt that
he would govern California more effectually
than California could govern herself.
He rejoiced that the hour and the man was
at hand, when aud by whom the same power
would be exercised with equal effect. He had
no fear that either the new President or Persi
for Smith vvolud exercise any undue power un
der this act. Neither a State or a Territorial
government, he conceived would be commen
surate at this time with the objects to be at
tained.
Mr. Webster said he should be borne out,
he thought, in the declaration, that he had had
no part in producing the state of things now
existing. Though he had opposed all mea
sures calculated to produce them, he did not
propose to mingle in the present discussion
anything referring to the past. It was enough,
at present, to provide for those territories
which, as one of the results of past acts, had be
come a portion of the United States.
And while he had no intention to refer to the
past, he did not think it either wise or prudent
to look too far into thejfuture—to exercise any
far-reaching insight or superior powers of pre
science. To give security to the well disposed,
and provide restraints for the badly-disposed,
was all that he had contemplated by the propo
sition which he had yesterday laid before the
Senate, and for which, at some proper time,
he intended to ask their consideration.
The government for the present, he con
ceived, should be essentially a military govern
ment, limited to th<§ object of preserving peace,
without attempting to administer the revenue
laws, because any such attempt would be im
practicable. In the case of Florida, provision
was made for the extension of the revenue
laws, but it all came to nothing—not SIOO was
realized, until the establishment of a regular
territorial government.
The whole corps of revenue officers re
quired, would all be doing nothing, for how
could they do anything while no courts existed
to regulate the operations of the laws ? No
seizures could be made ; if so, there could be
no adjudication. It would be expensive, give
unnecessary power to the executive, and use
less.
The House had sent them a bill purporting
to extend the revenue laws over California.
The proper course, he conceived, was to resist
all amendments to the appropriation bill, pro
viding either for State or Territorial govern
ments, while another measure far more suita
ble, was before them —and it may be taken up
at anytime—he should move to strike out all
after the enacting clause, and insert the propo
sition which he had yesterday laid upon the
table of the Senate. He was in favor of ma
king all proper provision for the government
of California, and the bill which he proposed
to submit, he conceived to be all that was at
present necessary.
Mr. Foote followed in reply to Messrs. Day
ton and Webster. He spoke at great length,
and when he bad concluded, the Senate ad
journed.
House of Representatives.
On motion of Mr. Vinton, the House then,
116 to 63, resolved itself into committee of the
whole on the state of the Lnion, Mr. White, of
New York, in the chair, and took up the bill
d ‘ making appropriations for the service of the
PostOfiice Department for the year ending 30th
June, 1850. ” .
The whole day was spent in discussing this
bill.
The steamship Niagara, Capt. Stone, sailed
from Boston, at 1 o’clock on Wednesday, for
Halifax and Liverpool, with 8 passengers for
the former and 54 for the latter. The mails
which left New York on Tuesday evening did
not arrive until Hi o’clock. The steamer had
left her dock, but the mails were put on board
by one of the East Boston ferry-boats. The
Niagara carries upwards of 50,000 letters.
Charleston Courier.
The Hon. John M. Clayton, who it is now
known is to be at the head ot Gen. Tayloi s
Cabinet, appeared in his senatorial seat at
Washington on the 21st inst. He has trans
mitted to the Legislature of Delaware, the re
signation of his commission as Senator ol the
United States from that State, which was to
have taken effect on Friday last. The Legis
lature was to have assembled in joint Conven
tion on that day to elect his successor.— -Chat,

The Devil-Sticker of Sooth America.— ln
many of the huts or habitations in the Indian
villages passing up the great rivers, is to be found
the devil-sticker. It is of a soft spongy nature,
and smooth skin, not unlike the large slug of
England. It is brought into the hut with the
fire wood, or it may creep up the side wall, and
getting on the edge of the rafters of the ceil
ling, to which it adheres, it looks like a small
ball, or more properly, like the slug coiled up.
It is frequently known to drop from its hold
without being molested, and wherever it falls it
throws out from its body five or six fangs, which
are barbed like a fish-book, and into whatever
softer material than brick or stone it chances to
fall these fangs enter; nor can it be removed
unless by cutting the animal otf and picking the
prongs out.
Niagara Falls.— At no former period has
that great work of nature been so attractive
and beautiful as at the present. The cold
weather has congealed the spray on the trees
on Goat Island and along the margin of the
river, forming a wonderfully brilliant spectacle.
A drove of two hundred cattle from Michigan
passed over the wire Suspension Bridge, below
the Falls, yesterday afternoon. —Buffalo paper.
The Ohio House of Representatives has, by ’
a decisive vote, instructed a committee to re
port a bill repealing all laws granting license to |
sell intoxicating liquors.

This may certify that I am about seventy-five years
of age; was born and have always resided in this
town. In October, 1345, I took cold and for six months
was afflicted with the influenza and the worst cough
I have ever experienced during my whole life. My
self and friends had strong doubts of my ever recov

for me several times, but did not cure me. At last
