AN ORDINANCE.
SECTION FORTY-FIFTH. —No person shall retail
spirituous or fermented liquors in less quantities than
one quart within the limits of the city, without a license
irom tbe City Council, which lioe se shall be designated
as No. 1, and the price of which shall be sixty-five dollars.
No person shall vend any spirituous or fermented
liquors in quantities of one qusrt or one gallon, or in any
intermediate quantity, without a license from the City
Council, which U:ense shall be designated as No. 3, and
the price of which shall be five dollars.
Every person desirous of obtaining a license, shall ap
ply in writing to the City Council, stating the number of
the 1 cense for wnich application is ma e, mentioning the
place where he or she intends carrying on suoh license
trade, and accompanying the application with a certificate
of two or more respectacle inhabitants of the immediate
neighborhood in which such license trade is to be carried
on, recommending the applicant as a fit person to be en
treated with snob license: Provided, however, that no one
shall sign more than o e certificate, and that no such cer
tificate shall be signed by any person possessed of or ap
plying for a license.
All licenses shall be and continue in foroe until the first
day of October next after the same are granted, uni ess re
voked as hereinafter provided, nor shall there be any
abatement of the price of license under any circumstances.
If Council grant the permissions equested, the appli
cant shall, before the licence is taken out, produce to the
Clerk of Council the receipt of the Collector and Treas
urer, for the price of such license, andgive bond with ap
proved security in the sum of Five Hundred Dollars, for
keeping a decent and orderly house.
No retail License sball.be transferred from one person
to another without the consent of the City Council, nor
•hall any person be allowel to retail in more than one
place or room, at the same time under one License.
No person shall be permitted to retail spirttous or fer
mented Liquors in any of the Streets of this City, under
any pretext whatsoever.
License retailers shall within five days after obtaining
their license affix a sign near to or over the door of the
tenement in which the retailing is carried on, upon which
sha l be painted in plain character* the words “License
Retailer of Spiritu* Liquors,” which sign shah be con
tinned until the expiration of the license and not a
day longer. No retailer shall sell spiritons or fer
mented liquors on Bunday or on City, State or County
Election day’s, rnr between the hours of 13 o’clock,
at night, and one hour before snnrise nor after 11 o’clock
on Saturday night, nor shall they when not permitted to
retail keep open the doors or windows of their retail shops.
Provided, That keepers of Hotels may be allowed to
furnish spirituous Liquors to their regular guests on Sun
day at their table*.
No License retailer i.f spirituous or fermented liquors
shall permit any slave not owned by him or her, or lawful
ly under his or her care, or charge, to enter h'sor her
retail shops, or retra n in it or on the lot attached there
to, at any time, or to loiter about the door or in the yard,
of any house where spirituous liquors are retailed.
No License retaler of spirituous liquors shall give or
furnish any spirituous or intoxicating} liquors, or permit
them to be given, told or ftrnished, by any person in Lis
or her employment, to any slave or free person of color, or
minors, without tbe written permission of the o ner or
hirer oi said slaves, or guardian oi said free person of
color or minor.
Any license may be revoked by the City Council when
ever the party to whom it may have been granted shall
be convicted before the Police Court, or the City Council
of a violation of this Ordinance for ihe second time, and
th 3 party whose license is thus revoked shall not again be
allowed to hold a license to re.a l for two years from the
date of such revocation.
The following oath shall be taken by every person ob
taining a li:ense, to be administered by tbe Clerk of
Council;
I do solemnly swear that I will not, during the contin
uance of my been e, sell, barter, give or furnish to any
slave or slaves, or free person of color, any measure or
quantity of distil'eu spirituous or intoxicating liquors with
out the verbal or written consent of the owner, overseer
or employer of such slave ot slaves, or without the like
consent of the Guardian of such free per*, ns of color,
and I do furtder swear, that I will not suffer or allow
any other person to do so for me, my approbation
knowledge or consent. And that I will not know
ingly and intentionally violate any of the provisions
of this Ordinance, under which I hold my license, provided
that nothing in this Ordinance and the foregoing oath
shall be so oonstrued as to apply to cases of sales of liquor
for medical purposes so help me God.
It shall be the duty of each and every perton permitted
to retail i pirltuotu liquors, to admit the Mayor, or any
member of Oonncil,or either of the City officer*, into bis
orher premises at any time whei such permission may
be demand'd. Any person violating any part of this
section shall be fined in a sum not exceeding one hundred
dollars.
Be it farther Ordained, that all Ordinances, or parts of
Ordinances mi Rating against this Ordinance, be and .the
same are hereby repealed.
