(Concluded from our lajl.) AND be it further enacted, That the mas , ter or other person, having the charge or command of any (hip or veflel, ((hips and vell'els of war excepted) coming into, or ar riving in any of the ports or diftrids of the United States, or in any of the cieeks or har bours thereof, (hall, within forty-eight hours after such arrival, repair to. the office'of the collector of the district where foch veil'd (hall so arrive, and (hall report to the laid collec tor, the place from whence he last failed, with the name and burthen of his (htp or veflel, and (hall deliver to such colledor, two mani iefts, agreeably to the Hi regions of this aft, unless he (hall before have delivered one raa nifeft to some officer, or other person lawful ly authorifed in manner gslierein before is re quired ; in which case, he (hall deliver the manifeft certified as aforefaid, together with such documents as are ufnally furnifhed in the port from whence they came, and (lnll take and fubferibe an oath or affirmation, before the collector or other proper officer, which oath or affirmation be or they are authorifed and required to administer, and (lull be in the words following, to wit: “ I, —» « do folcmnly swear or affirm, (as the case «c may be) that this is, to the bell of my ** kn wledge and belief, a just and true ma tt nifeft of all the goods, wares and mer c* chaudize, onboard the , at the port « fiom which (he last failed, at the t-ime of tc her failing, or at any time since, and of « which vellel I am at present master.” And if the master, or other person having charge or command of any such (hip ot vellel, (lull negied or refufe to make entry, or deliver Lis manifefts and documents, ' purfuanf to the diredions of this ad, or to take the oath or affirmation herein prefcribed,'he (hall forfeit and pay five hundred dollars for each refufal or negled. , . - And be it further mailed, That no goods, waies or merchandize," (hall be unladen or delivered, from any (hip or veil'd, but in open day, or without.a permit from the colledor for that purpose; and if the master or com mander of any (hip or veflel dull fofTer or permit the fame, such master and command er, and every other person who (lull be aid ing or a flirting in landing, removing, housing, or'otherwife securing the fame, (lull forfeit and pay-the sum of four hundred dollars for evgry oiTence; (hall moreover be di famed from holding any office of trust or profit under the United States, for a term not exceeding seven years ; atid it (hall be the duty of the colledor of thediftrid, to advertise the names of all such persons in the public gazette of the Hate in which he resides, within twenty days after each lefpedivc convidion. And all poods, wares and merchandize, so landed or difeharged, (lull become forfeited, and may be seized by any officer of the cufloms ; and where the value thereof (hall amount to four taXd Mb* w«. »•««?, arp^l, cud furniture, (lull be fubjtft 10 like fotfti; ture and feiznte t Provided always I«** ” \ny (hip or vellel, compelled by dirt rei» of weather, or other Efficient c*ufu, «•’*•« l»‘»t Jtilo any port or place of the United butc^ GEORGIA other than to which (lie was adually destined, the niaftet or other person having command, (hall, within forty-eight hours next after his arrival, make report and deliver a true mani fest of his cargo to the collector of the port or diltrid; and moreover thall, within ty-tour hours, make protest in the usual form before a notary public or jnftic of the peace, of the cause and circumflances of such distress \ and if it (hall appear to the colledor, that there is a necessity for unloading such (hip or veil'd, be (hal! grant peimiffion, and appoint a proper officer to attend the unloading there of; and all goods, wares and merchandize, i'o unladen, lhall be Itored under the direction, and fubjed to the lase keeping of such collec tor; but if any part thereof (hall be of a perilhable nature, or it mar be uecedary to make sale of any part thereof 10 defray the expcnces of such veflel or cargo, the laid col lect r (hill grant a licence to the master, commander or owner, to dispose of so much thereof as arc peruhable, or (ha 1 be neceli'ary to delray such expeuces: Prodded, That the duties thereon be fiifi paid or feeured : And provided ulo, That such necessity be made appear by the wardens of the por., or other [ erf ns legally authorifed to certify the fame, and where there are no such persons, by tiie affidavit of two reputable citizens of the neighbourhood, heft acquainted with matters of that kind. And be it further enabled, That every per son having goods, wares or merchandize, iii any (hip or veflel, which (hall arrive at any port of emry, or of delivery only, dull make entry with the collector of the port or diftiid where the fame lhall arrive, of all such goods, wares and merchandize, fpecifying me num ber ot packages, and the marks, numbers and contents of each, (or if in built, the quan tity and quality) together with an account of the nett prime cod thereof; and fliail more over produce to the colledor, the original invoice or invoices, together with the bills of loading: And thefaid collector lhall estimate and endorse the duties on the laid entry, the party making such entry tatting an oath or affirmation, that it contains the whole of the goods, wares and merchandize, imported by him, or to him configntfd in Inch (hip or ves sel, which lhall then have come tolfis know ledge, and that the fzid invoice contains, to the bed of his knowledge and: belief, the nett prime cod thereof, and that if be (hall after wards dilcover any other, or greater-quanti ty than is contained in ftch entry, he will make due report and entry thereof; and the said oath or affirmation (hall be admmirtered by the collector, and the entry lhall be fin (cubed by the pet foil making the fame : Pt o , njjded, That in allcales where the party mak ing entry mail reside ten mnes or upwaids from loth port, the affidavit or affiruiatj-iii of jucb party, taken before a fufitce ul the pr *ce, and by him endorsed on the original invoices, (lull be as effectual as if admiuifterei! ami en dorsed by the colledor.
