HEREAS in order that the Ordinance V <. of the United States in Congress af embled, for the government of the territory *oi th weft of the river Ohio may continue to have full effetf, it is requisite that certain pro vision lhould be made lb as to adapt the fame to the present Constitution of the United States; . ... And be u fun her enacted , That in cases of the death, removal, telignation, or neceilary absence of the Governor of the said territory* the Secretary thereof fliall be, and he is here by auihonfed and required to execute ail the powers, and perform all the duties of the Governor, during the vacancy, occafioncd by the reinov il, refutation, or neceilary absence of the said Governor. BE it enatted by the Senate and House of Reprejentatives of the United States of America in Congrejs as embled, Tha there ffiall be an Executive Department, 10 he denomi nated, the Department es War; and that ■ there lhall be a principal officer therein, to be called the Secietary fur,the of War, who lhall perform and execute such du ties as lhall from time to time be enjoined on, or entrusted to him by the Piefident of the United States, agreeable to the Courtitution, relative to military conmiiffions,. ur to the land, or naval fortes, thips, or warlike (lores of the, United States, or to such other matters refpefting military or naval, .affairs, as the Pi eh dent of the United States shall allien to the said department, or relative to the grant ing of lauds to persons entitled thereto, for military services rendered to the United States, or relative to Indian affairs ; and furthermoie, That the laid principal officer, lhall conduct the bufiuefs of the said department in such manner, as the Piefident of the United States lhall from time to time order or inrtrud. Ana be it further matted, That there lhall be in the said department an infeiioc officer, to be appointed by the said ptimipal officer, to be employed therein as he fliall litem pro per, and to be called the Chief Clerk in the -Department of War; and who, whenever the said. principal officer fliall be removed from office by .the President of the United States, or in any other case of vacancy, shall doting such vacancy, have the charge and cuflody of all records, books and papers, ap pertaining to the said department. And be it further matted , That the said principal officer, and every other perfonto be appointed or employed in the said depart ment, lhall, before he enters on the execution of this office or employment, take an oath or affirmation well and faithfully to execute the trull committed to him. Provided nevertbelejs , That none of the said expencea lhall continue to be so defrayed by the United States, after the expiration of one year Jiont the day aforefaid, unless such light-houses, beacons, buoys and public piers, lhall in the mean time be reded to and verted in the Unit- . ed States, by the flateor Hates refpedtvely in which the fame may be, together with the lands and tenements thereunto belonging, to*, gether with the jmifdidion of the fame. An'd be it Jurther enabled , That a light-, house fliall be irfeded near the entrance of the Chesapeake Bay, at such place, when ceded • to the United States in manner aforefaid, as the President of the United States lhall direst. .* And be it further enatted, That it lhall be the duty of the Secretary of the Tteafury to provide by coin rads which fliall be approved by the Piefident of the United States, for building a jight-houfe near the entrance of Chelapeake Bay, and for re-building, when necertary, and keeping in good repair, the ljght-houfes, beacons, buoys and public piers, ip the several. Hates, and for furnilhing the fame with all necessary supplies, and also to agree for the salaries, wage* or hire of any person or persons appointed by the President, for the fuperintcndance and care of the fame. . And be it further enatted , That all pilot* in the bays, inlets, livers, harbours and port# ot the United States, lhall continue to be re gulated in conformity with the cxifting law# of the Hates refpedively, wherein such pilot# may be, or with such laws as the Hates may refpedively hereafter enad fur the purpose, until further legiilativeprovifionfliall be made by Congtefs.
