(hip or vessel (hall not be employed in any
traffic or commerce, with or for any per
son resident within the territory of the
French republic, or any of the dependen
cies thereof.
Sec. 3. Provided, and be it further
enafted, That when any (hip or vessel
which (hall obtain a clearance for a so.
reign voyage, after a bond (hall be given
as atforefaid, (hall be compelled by distress
of weather, or other casualty endangering
the fafety of such (hip or vessel, or of the
mariners on board the fame, or (hall be
taken by any armed vessel, or other su
perior force, into any port or place with
in the territories of the French republic,
or any of. the dependencies thereof, and
(hall there neceffmly unlade and deliver,
or (hall be deprived of any cargo then on
board, then, and in such case, the master
or other person haying charge of such fhijS
or. vessel; may receive compensation or
payment in bills of exchange, or irt money
or bullion, for fuefi corgo, but not other
wise, and (hall not be understood thereby
to contravene this law, or to incur a for
feiture of the said bond.
Sec. 4» , And be it further enaAetß
That no ftrip'Or Teflel coming from any
port or place within the territories of the
French republic, or any of the dependen
cies thereof, whether with or without a
cargo, or from any other port or place,
with a cargo on board obtained for, or
laden on board of such vessel at any port
or place within the said territories or de
pendencies, which (hall arrive within the
limits of the United States after the said
second day of March next,. (hall be ad
mitted to an entry with the coUedlor of
any ‘diftritt; and each and every such (hip
or vessel which (hall arrive as aforefaid,
having on board any goods, wares or
merchandize, destined to be delivered
within the United States, contrary to
the intent of *his aft, or which (hall have
otherwise contravened the fame, together
with the cargo which (hall be found on
board, (hall be forfeited, and may be
seized and condemned in any court of the
United States having competent jurisdic
tion : Provided, That nothing herein con
tained (hall be construed to prohibit the
entry of any vessel havinga passport grant
ed under the authority of the French re
public, and solely employed for purposes
of political or national intercourse with
the government of the United States,
and not in any commercial intercourse,
and which shall be received, and permit
ted by the President of the United States
to remain within the fame: And provided
alfi, ’That until the firft day of August
next, and no longer, any (hip or vessel,
wholly owned or employed by a foreign
er, other than any person resident in
France, or in any of the dependencies of
the French republic, and which coming
therefrom (hall be destined to the United
States, and (hall arrive within the fame,
not having otherwise contravened this
aft, (ball be required and permitted to de
part therefrom, and in case (he (hall ac
cordingly depart, xvithout any anreafona
b!c delay, and without delivery, or at
tempting to deliver, any cargo or lading
I within the United States, such (hiporvef

the lame, (hall not be liable to the forfei
ture aforefaid.

Sec. 6. And be it further enacted ,
That at any time after the passing of this
aft, it (hall be lawful for the President of
„ States, by his order, to remit
'and dilcontinue for the time being, whene
ver he (hall deem it expedient, and for the
interest of the United States, all or any
of the restraints and prohibitions imposed
by this aft, inrefpeft to the territories of
the French republic, or to any idand,
port or place belonging to the said repub
lic, with which in his opinion a commer
cial intercourse may be fafely renewed;
and also it (hall be lawful for the President
of the United States, whenever he (hall
afterwards deem it edient, to revoke
such order, and hereby to re-eftablifti such
restraints and prohibitions: And the Pre
sident of the United States (hall be, and
he is hereby authorized, to make procla
mation thereof accordingly.
Sec. j. And be it further enacted,
That the whole of the idand of Hispaniola
(hall for the purposes of this aft be confi
dcred as a dependency of the French re
public :' Provided, That nothing herein
contained (hall be deemed to repeal or an
nul in any part, the order or proclama
tion of the President of the United States,
heretofore issued for permitting commer
cial intercourse with certain ports of that
illand.
Sec. 8. And be it further enaßed,
That it (hall be lawful for the President of
the United States, to give inftruftions to
the public armed vessels of the United
States, to flop and examine any (hip or
vessel of the United States, on the high
sea, which there may be reason to fufpeft
to be engaged in any traffic, or commerce
contrary to this aft ; and if upon exami
nation, it (hall appear that such drip or
veflel is bound or failing to, or from any
port or place contrary to the true intent
and meaning of this aft, i: (hall be the
duty of the commander of such public
armed vessel, to seize every (hip or vessel
engaged in such illicit commerce, and fend
the fame to the nearest convenient port
of the United States, to be there prose
cuted in due course of law, and held lia
ble to the penalties and forfeitures pro
vided by this aft.
Sec. 9. And be it further enaßed,
That all penalties andforfeitures incurred
by force of this aft, (hall, and may be
examined, mitigated or remitted in like
manner, and under the like conditions,

. mitigating, or remitting, the forfeitures,
penalties and disabilities accruing in .cer
tain cases therein mentionedand all pe
nalties and forfeitures, which may be re
covered in pursuance of this aft in confe
quenceofany fcizure made by the com
mander of any. public armed veflel of the
United States,Efhall be distributed accord
ing to the rules prescribed by the aft,
intituled ** An aft for the government of
the navy of the Unir<4 States and all
other penalties ariling under this aft, and
which may be recovered, (hall be diftri-.
buted and accounted for in the manner
preferibed by the aft, intituled ** An aft
to regulate the coHeftion of duties on im
ports apd tonnage.**
Sec. 10. And be it further pnaftti,
That nothing contained In this
extend to any (hip or veflel to which the
Prefidenc of the United States (hall grant
a permif&on to enter and dear; provided
such (hip or veflcl (hall be solely employ
ed, purfnant to such permiflion, for pur
poses of national intercourse; and mall
not be permittedto proceed with, or to
bring to the United States any cargo or
lading whatever other dutii necessary fea
ftdres.
Sec. tt. And he it further ettv ffedj
That the aft, intituled <* Air aft Anther

the dependencies thereof,’* (hall he, and
is hereby continued and flurtl be taken
to be in force in refpeft to »M offences,
which (hall hate been committed against
the fame, before the expiration thereof
and to the intent that all fetzums, for

fence*, may be had, sued for, jjrofpcuted
and recovered, any limitation ofthe (aid
aft to the contrary hereof notwithstand
ing. •*
'Sec. 12. And be it further enafied ,
That this aft (hall be and remain in force.,
until the third day of March, one thou
sand eight hundred and one : Provided,
however, The expiration thereof (hall
not prevent cr defeat any seizure, or
prosecution for a forfeiture incurred under
this aft, and during the continuance
thereof.

An ACT for the relief of James Yard.
BE it enacted by the Senate and Hot'fe
of Representatives of the United
Stales of America, in Congress ajfembled,
That the term of fix months, trora and
after the palling of this aft, (hall be, and
is hereby allowed, as a further time for
the exportation, with the benefit of draw
back, of one hundred and fix pipes, - eight
hoglheads and five quartercaiks of Madei
ra wine, which were duly (hipped, and
with the benefit of drawback, in the
months of March and April, of the year*
one thousand seven hundred and ninety
eight, by James Yard, on board the (hip
Ganges, then bound to India, but after,
winds re-landed in confequneceof the pur
chase of that (hip by the United States,
and any drawback which (hall accrue on
any parcel of the said wine, which beiog
fir ft duly identified, (hall be. exported
within the term, aforefaid, (hall be paya
ble in fifteen days after fuch%xportaticn,
and a debenture or debenture* may Hfiie
for such drawback upon the like security,
.conditions and proofs, as are required in
other cases, and to be paid in a similar
manner.
