Extract from an aft entitled , an Aft fir
regulating the infpeftion of Tobacco.
Be it enacted, “ That from and immedi
ately after the palling of this ail, no person
• ftiail put on board,or receive into any (hip,
l' brigantine, boat or other vessel, in order
to be exported therein, any tobacco which
pull not have been packed in hogflteads or
calks, before the fame (hall have been re
ceived and infpeiled according to the direc
tions of this ail; that all tobacco whatever
to be received or taken on board, any tliip,
brigantine or other vessel, and to be there
in exported or to be carried and pat on
board any other (hip, brigantine, or other
vessel for exportation as aforefaid, (hall be
received or taken on board at the several
ware-houses for that purpefe est ;bibbed by
law or Corns or one ot them, and at no o
thcr place or places whatfqcver ; and any
cuftcr, mate or boatfvvain of any Ihip or o
ther vedel, which (hall arrive in this date
in order to load with tobacco, (hall, before
the laid fa ip er vessel be permitted to take
on board, any tobacco whatever make oath
before the collcAor of the customs of the
port where fnch (hip or vessel final! arrive,
that they will not permit any tobacco what
soever to be taken on board their refpeitive
Ibips or other vcffcls, except the fame be
packed in hoglhcads or cailcs, ftairped by
some infpeftor legally therennto appointed,
and if any mailer shall cause any person who
is not really and bona tide mate or boat
swain, to come on shore and take fnch oatn,
he shall for said offence forfeit and pay five
hundred pounds ; and if any commander or
mailer of any (hip or veflel (hall take on
board or fuffer to he taken on board the
ship or vessel whereof he is mailer, any to
bacco brought >from any other place tnan
such public place as the law eftablifnes or
any hoglhead or calk of tabacco not damped
by such lawful infpetlor, or shall fuffer to
be brought on board any tobacco except in

every such commander or mailer (hall forfeit
and pay twenty pounds for each hoglhead.
And be it further enafted, “ That every
mailer of a ship or vessel wherein tobacco
shall be laden, (hail at the time of clearing
out deliver to the collcflor a fair manifeft of
all the tobacco on board his Hasp or vessel,
expressing the marks and numbers of every
hoglhead and the tare and nett weight (lamp
ed thereon, the person by whom (hipped,
and from what warc-houfe ; and (hall make
oath thereto, that the fame is a true and
just account of the marks, numbers, rare
and nett weight of each rcfpeflive hogshead,
as the f.tne was taken down by the person
or persons appointed by him to take the
fame before the said tobacco was (lowed a
away ; and no (hip or vessel (hall be cleared
by the collectors- before he (hail have receiv
ed such lift or manifeft.”

letter from the fuperintendant of Indian af
fairs in the Creek Nation, mentioning
that he had directions from the Secretary of
War, reflecting the running and marking
the boundary line, between the Creek Indi
ans, -and our stare, as agreed on by the trea

ral John Clark, and Majors David Adams
and jeffe McCall, as Commissioners on the
prrt of the State, to fuperinrend the fame.
In February following, I was apprized of
its being run and marked, from the high
fhcals of the Appalachec, to Polmcto Creek,
the lower extremity of Wilkinson county
—and that the fuperintendant Col. How
kir.s, who was the United States Commlf
fioner, for this bufir.efs, had informed the
1 commissioners of Georgia, that, from the
disposition of part of the Indians, manifeft
ed to him by a deputation from the nation,
he should be conftratned to defer the running
of the lower line, till the month of May—
Copies of the documents, which will give
you all the information 1 am pofftffed of on
this fubjcdl, will be found marked No. i.
I thought proper however to direst the
Diftrift Surveyors for the counties of Bald
win and Wilkinson, to proceed to the du
ties required of them, and for that purpose,
on the J K ot March, tVvcy raccvvCll the a
mount directed, by the ads, of the iith of
May, 1803, to be advanced to them. I
have inftrufted the Surveyor-General, to
report to you the manner in which the work
has been executed, and how far it is com
pleted.
Not having received, until the last
Au<mft, information of the completion of
the°lo'.vcr line— and confiderablc difficulty
hawing arisen in procuring a surveyor to
supply s the place of Mr. Bird, who was ap.
pointed for diftria No. 2, in Wayne conn
ty, and resigned, the farveying of that
county is not, nor will it be, for fomc time,
finifhed.
Among the documents marked No. 1, is
a copy of an affidavi r, which was enclosed
to me by the commissioners who superintend
ed vhe running ot the line, on twe part of
the State, setting forth that peifcns had
been engaged in ferveyirg the land over the
Oconee riVcr. Viewing inch proceedings
as a direst violation of our laws, I deemed
' it proper to issue the proclamation, a copy
of which is also subjoined.
In purfoancc of the act of the Legislature,
for laying out the county of Walton, I

Alter the time had expired, for which
the law stood suspended, the judiccs of the
inferior court were qualified, the civil and
military officers elected, and commilfioned,
and the county completely organized-—buc
it is with great regret 1 have to inform you,
that from the representation of feme of the
principal county officers, the .laws of the
ftafe, cannot, in that quarter, be carried
into effe#, and that irregularities are con
stantly taking place between pur citizens,
and thofc of Notth-Carolinp. Your atten
tiott will therefore be drawn to the ftcpj,
ncceffary to be taken for fettling the dif
pote,' between the two States, relative to
boundary, and for coming to such an tin
ker dandling,. with government of N.
Carolina, as will insure, for the future, a
conduct, on the pan of those of her citizens,
adjacent to Walton county, more confident,
than their’s has been, with that of a peo
ple living under the control of law, and
produce that harmony which certainly
ought to fubfill between filler dates. In
addition to the information on this fubjefl,
which you will derive from the copy of a
letter marked No. 3, I mud refer you to
the Senator and Representative of Walton
county, who will no doubt readily afford
all within their knowledge.
Agreeably to the concurred and approv
ed resolution of the nth December lall, I
appointed commifiioners to repair to the
Creek Nation, to demand of the Indians,
the property, or rediCation for it, which
they have at different times taken from A lhc
citizens of this Hate, and which they have,
by different treaties, ftipulatcd (hould be
returned. The fame gentlemen, who fu
perin tended the running of the line, between
the Hate, and that Nation, were fcleCted
for this purpose—-because it was deemed

the Indians, acquired fomc
with them, and perhaps gained their con-,
fidence. I am forty to be obliged to in
form you, that the refnlt of this million
was unfuccefsful. A copy of my letter of
infiruflions to the commifiioners, and an
extra# from their journal are marked No.
4. The last mentioned document will prove
to you, that the exertions of the commis
sioners were not wanting to accomplish the
obje#, for which they visited the In
dians, in such way as would have been con
formable to existing treaties with them, and
fatisfaftory to thofc of our citizens moil in
tended.
At a meeting of the Creek Indians at
Toukabatchce, in July lad, the General
Government, through the fiuperintendanc
of Indian affairs, again uigcd them to cede
to the United States, as much more of their
territory, as would make the Ocmulgee our
boundary. The packet No. 5 contains a
copy of h where
in he dates, that tncafurcs are in a train, by
which he is induced to suppose that before
the termination of the year, that definable
ohje# vtfill be accomplilhed.
Commifiioners have been appointed as di
rc#ed by the resolution ofi the Legiflaturc,
pafftd at the lad extra fcfilon, for defignar
ing and laying out the road from the date
ofTenneffee, through the Cherokee nation
to this State. The gentlemen fdcifted fee
this hufinefis are, William Barnett, Rode
rick Eafiy and Buckner Harris, tfiquircs.
I Battered myfelf that I fhouid have had it in
my power to inform you, that the road was
nearly completed ; but very little has yet
been done. The copies of letters marked
No. 6, will inform what prog refs has
been made and how much of me road the
State will have to open.
As four new counties have been laid off
in our lately acquired territory, a revision
of the judiciary fylfcm may be proper be
fore you proceed to the election, which
mud take place this fieffion, of Judges of
the Superior Courts; in order llut, when
fettled and organized, courts may be held
within them agreeably to the Conltitutibn.
