Ii tins alteady bf*t*n announced that anew trial had been refused in the case of the ship Alexandra, in FiUglaiul, which was a decis ion in lavoror ihe Confederates, and that the Attorney General intimated his intt-n --lion to take an appeal. The following is the judgement rendered in the case by the Lord’Chiel Baron, ia the Court of tire Exchequer; He said the present was an information against the ship Alexandra, charging that the defendants, with others, had been guil ty ofa violation of he Foreign Enlistment act. 'Pile Alexandra had been built and partly rigged ;»t Liverpool, and seized by an officer of the customs for a breach of the act alluded 10. The defendants joined issue and pleaded that the ship was not forfeited. The information charged the de» fendants with every possible violation of the act as to the furnishing, equipments, &e, but said nothing about arming. The question arose whether that established the warlike character of the vessel. It was urge and ihat the vessel was not adapted for j warlike purposes, and although it might be used as a yacht, it was doubtless intern* ded to be used by the Confederate States of Am l io-i against a power with which her Majesty was friendly. It was also urged that there wa:ftui intention to sell to one ol the belligerents the null of a vessel suit able tor wmi but unarmed, but to do any warlike act whatever was a violation- ILs direction to ihe jury was that in such a c.ifce the defendants were neither within the iiiearmig of the act but if the commerce of this country in ships, for peace or war, was to continue, and a ship left tiie ports of this country in a condition to cruise out or to commit hostilities, thought it might be of a warlike character, he should hold lliat there had been i.o violation of the statute, and tha! the verdict ot the jury was right. This was the substance of the case between the crow n and the defendant—stripped of all technicalities. The learned judge went at some length into the nature ot hisdiiec- Ut n to itm jury at the trial, in the course of which lie stated that if the ship had not been equipped, furnished, and fitted out, the case did not come within the meaning of the act, and there had been no violation ot the statue. There had been no direct evidence that it was intended ic arm the Alexandra in any Bruish port for tbe pur pose of cruising or committing hostilities; indeed, there was no charge in the infor* mation on the subject of arming at all. He, however, left the question to the jury iu the terms of the act of Parliament, and they found a verdict for the defendants, on which the attorney general obtained a rule nisi tor anew trial. Cause was shown during term, and the arguments lasted six days.— The various charges in [lie information con sisted of ninety eight counts. The first eight counts were repeated twelve times, varying the charges of cquioping, furnish* ing, iii ting out. He, thus making ninety six counts. The Attorney General had, in fact, stated i.li.uL ihe first eight counts rep* rese.i tej all the rest. Tire charges, there— fme, resolved themselves into what wan meant by furnishing, equipping, etc , with intent. The question then arose which was the true construction of the Foreign Enlistment Act, and what was meant by tiie j rohil"ition to crush or to commit boss rilit-ies The learned judge quoted from Black stone to show that judges were bound lade, id** such eases according to the strict letter of tin* law. The insii iUions of the country, he believed, were never more se cure than now, but he thought the country con'd nrrer afford to lose any of the ground' of security. Tire learned judge then pr. needed to in* quire what was the real interpretation of the words used in the statute, and h»-ld that unless the alleged etime was plainly within the tt itno Ihe court ought to decline to in terfere. Io his judgement it was not within tire Maine, and that ii was never content* plated ttv those who flamed the law. He thought that he might decline I al it was law lul to Imild ships in tin- country; even for warlike purposes. NtT.bmiding was one of iiie nul-t i.upoiiani of our industrial pure nils, and the building ot skips, even for warlike purposes, was not unlawful, ptovi dvd th :t they were not equipped, turmshed nr tilted out in our ports, with ihe intent stated ui the act. Reverting to the For eign E li-ioie'.'l sc , Ihe learned judge said they were familiar in Westminister Hall wit.il toe phrase, "to drive a coach and eix tluougii an act ol Parliament.” It would not, lie thought, ho ditli.;iilt to aatl a whule 11. ot ot ships through Ihe act, so clumsily was it constructed. Mystery, impenetrable to the ken of military experience, hangs over the movements of the enemy in Mississippi. If he was ooming here by a forced maroh, with his food on the baoks of his soldiers, he ought by this time to be with in hailing distance of oar pickets. A few more days will be fatal to that celority of movement which te the first condition of its success. Yet we can bear of no Yankee soldier south of the Southe'n Railroad. What then can be bis ob joc:? To march northeast towards Coiumbas, or directly east to Demop'dis and Selma ? There is no conceivable objeot adequate to the peril. He will find corn, to be sure, and some meat to live upon—bat mills are needful to convert coin into food for man, and of ooaree the “Rebels” won't leave him their mills. Without innumem able cavalry to guard and forage for him, he will soon eat oat any neighborhood he ocou* pies, and therefore cannot remain still. Does he propose to go through to Northern Georgia and flank Johnston, while Grant assails him ia front? Thun why did he leave Corinth and North Mis si-sippt to oomo down hundreds of miles to Vicksburg, to begin that march ? He has left desolation behind him, and his rear open. This shows that ho has an objective point in front, aa i no thought of returning the same way he came. The whole thing is involved in mystery, and that mystery is as deep, apparently, in the mind of Gen. and the authorities, as it is with its and tho other outside observerers. A few days must develops the enemy's object. Meantime, lot us makeup our minds to prepare for and resist him whenever he appears and whatever devilish purpose he has in view—[Mo- bile Register, 14 b.
