Tribal Court Being Out of Exist
ence Then, Sentence is Void.

1 * Muskogee, I. T., Oct. 22—According to
| Federal Judge Springer there is at present
! no legal way of punishing a Creek Indian
for murder or any other offense committ
, <i il prior to January 1, 1898.
This ruling was made by Judge Springer
i in pacing upon the case of William Tiger,
■ a (’reek Indian convicted of murder In the
tribunal court before it was abolished by
' act of congress, and sentenced to be shot.
! Upon a writ of habeas corpus the Indian’s
attorneys carried the case into the Federal
| court alleging error in the tribunal court.
In passing upon the case Judge Springer
i held that the tribal 00111*1 had not erred
and the case was remanded to the tribal
court for execution of the sentence but
appeal was again taken to the United
States court of appeals for the Indian ter
ritory.
While the case was pending there con
gress passed the Curtis act, wiping out of
existence “in July last the tribal courts
and all their officers. The decision of the
tribal court was again sustained and tha
execution of the sentence ordered but this
decision was not rendered until after the
Curtis act became a law,
Again the Indian’s attorneys brought
the case before Judge Springer and the
latter’s decision that, the sentence could
not be executed, inasmuch as the court
had been abolished, was the result.
Similar decisions were also rendered in
the eases of Chiffon, Flennelly and Belch
er Smith, both of whom were under sen
tence of death by the Cherokee courts.
Judge Springer ordered the release of the
three murderers.
Incidentally Judge Springer announced
that there was now no law under which
punishment could tie inflicted for crimes
committed prior to January last in the
territory that was up to that time under
the jurisdiction in the courts of the five
Indian tribes.
The tribal courts alone had jurisdictions
up to that time. These courts have been
wholly abolished and the federal court has
no jurisdiction prior to January 10 last.

SPANISH MAUSERS.
Only About Seven Thousand of Them Are
Available.

Washington. Oct. 22—The board of of
ficers of the ordnance department which
were directed by General Flagler to in
quire into the condition of the Spanish
arms captured at Santiago has made Its
report.
The board finds that the Spanish arms
consist of two patterns, the Spanish
mauser of seven milimetre calibre and the
Turkish mauser of 7.65 milimetre calibre.
The cartridges for these arms are *of
course not interchangeable. There is only
a small per centage of the latter arm,
however, not enough to take into consid
eration the subject of restoring them for
use in the army.
Os the Spanish mausers it was found
that about three-fourths of them could be
utilized by taking parts of the remainder
and supplying deficiencies in the best
arms.. This would make, at a rough esti
mate 7.000 mausers available for use in
the army if needed. No decision has been
reached as to the feasibility of introducing
them into the American army and it is
possible that for the present they will be
held to await an emergency.
