lady was very anxious to own the set.
hut was not able to t*u> it. In these
eireunistanees Mr. Finch proposed a
novel kind of bargain. lie said that
he would sell Miss Waters the sot for ««•»•* f'«
one hundred kisses to he paid at the
rate of one kiss daily on eaeli and
every day next ensuing from the day
ol‘ the dale of the agreement, except
ing, nevertheless, each and every Sun
day thereafter. It was further pro
posed that Mr. Finch was to call at
the lady’s house every morning, ex
cept Sunday morning, to receive his
daily kiss, which Miss Waters under
took ami promised to duly deliver to
him. This contract was not reduced
to writing, hut it was fully under
stood and agreed to hv both parties,
and the sot of jet was tendered to
Miss Waters and accepted by her.
The next morning Mr. Finch call
ed on Miss Waters for his first kiss,
which, as the young lady now main
tains. was fully paid. On each sub
sequent morning for thirty consecu
tive days—Sundays excepted—the
same proceedings were had. On tl c
ihirty-tirst day. however. Mr. Finch
made a formal complaint that Mis-
Waters was not fulfilling her con
tract. inasmuch a* she insisted upon
]hTtiiiiling him to kiss her cheek only,
lie maintained that this did not con
stitute a legal ki-s ami he demanded
that lie should be allowed to put hi*
left arm arotiml her and kiss her in
the highest style of the art. To thi-
reqnest a firm refusal was returned.
The lady professed her willingness
to carry out her agreement so far as
her cheek was concerned, and even
offered to give Mr. Finch the choice
of cheeks, hut she insisted that the
contract would not hear the construc
tion pul upon it by Mr. Finch, ami
that she would never submit to such
a const ruction. Thereupon. Mr.
Finch, in great indignation, left the
lioti*e. and brought an action for
breach of contract against the latly.
This action raises several new and
interesting questions, among the
most important of which is: What
cui-tiititcs, in the eye of law, a kiss?
The testimony of several experts is
to Ik? introduced hy the plaintiff: but.
although all those experts will prob
ably start out with the assertion that
a kiss is that which is impressed h\
one pair of lips upon another pai ,
they will subsequently be coinpellei.
to admit on cross-examination that
one pair of lips alone may imprint a
ki-s upon any accessible object. This
seems, at first sight, fatal to the
plaititifTs claim that the defendant
did not furnish him with lawful cur
rent kisses, but it must be noticed that
lie sets up the further plea that there
is a difference between active and
passive kisses: that Miss Waters
promised to give him a certain quan
tity of kisses—not to permit him to
take them—and that giving kisses i-
au art which requires the use of the
lips. This is certainly a strong point,
and though the court may decide
that there is no one variety of kiss
which can be held to be the only kiss
known to the common law, it may
give an authoritative definition of an
active kiss which will be of immense
service to mankind.
It i9 maintained by counsel for de
fendant that there was no contract
between the parties, for the reason
that kisses cannot constitute a valid
consideration. The decision on thl
point will be eagerly looked for.—
That a kiss is something which can
be given willingly or taken by force,
and tliat it is commonly reputed to
possess more or less intrinsic value,
are points which the plaintiffs conn
sel will eloquently maintain. Hence,
it seems that a kiss may be a valua
ble and sufficient consideration upon
which to ba»e a contract. On the
other hand, it is asserted that courts
have never recognized a kiss as prop
erty capable of being stolen, ami that
when a kis9 has been seized by vio
lence the only remedy of the injured
person is an action for as-ault. It i-
evident that we have here a question
Which admits of a vast amount of ar
gument, and that its judicial derision
will mark an era in our common law
jurisprudence.

quainted with the fugitive's hiding-

detective in the guise of a carpenter
was told off to watch, ami endeavor
ed to strike up an acquaintance, In

than that he wa- an old man. He
was an elderly invalid, never went to
the door, saw nobody, and how was

round the place, in company with the

next. At the bark of the house was
a kennel containing a big dog, or
rather not containing him, for he
