Notice to the opposite party must accompany
'U copy of interrogatories served on him.
This was an action of trover, and the
defendant offered in evidence, testimony
taken upon interrogatories, which was
objected to by Mr. £>e Lyon, of counsel
t ,r the plaintiff, because no notice accom
panied the copy of the inferrogatories
served upi-n the plaintiff.
IIy the Court.—By the Judiciary act
;f 1799, (Prin. 211,) it is expressly re'
(lu ired that ten days notice shall be given
to the opposite paity, and that such no
tice shall be accompanied wi'h a copy <>f
the interrogatories. Here the party has
been served with a copy of the interroea-
tories, but no notice is attached to them,
and there is no evidence that such notice
was given; the law therefore has not been
complied with, and the testimony cannot
go to the jury. Interrogatories rejected.

A declaration without any direction to the “Su
perior Court.” allowed to be amended instauter
and without prejudice.
This was an action of slander, and the
declaration contained no direction lo the
“ Superior Court.” This matter was
pleaded by the defendant, and called up
at the trial, and the counsel for defendant
moved the Court f«»r a non-suit.
By the Court.—There is enough in
this declaration to show that it was intend
ed for this Court, and the defendant Ins
been served with process issued from tliis
Court. The direction >s only uniter of
form, and may now be amended under the
art of 1818. Let the ainendmeut be
made and <hi cause proceed.

Wide a vs. Veil.
Service of interrogatories acknowledged, and
waiver of the ten days, supercedes the necessity
of notice.
This was a bill in equity, and upon the
trial interrogatories were offered in evi
dence, which were objected to, because
no notice accompanied the copy of the in
terrogatories, but service had been ac
knowledged and the ten days waived.
Bv the Court.—The intention of the
law requiring ten days notice to be given,
was to apprise the opposite party of the
time when the original was given in the
Clerk’s office. Now in this case the par
ty has waived the ten days, and acknow
ledged nolice and service, and the object
of the law has been fulfilled, whereby the
written notice is superceded. Let the
interrogatories be read.
The Second Drawing will take place on

The building is to be sixty feet front, by nine*
ty deep, four stoTrrs high, of brick, the roof sla
ted. and the front rongh cast.
The basement story, containing two stores
and a passage, to be t«-n feet, pitch : the second
floor, appropriated to public purposes, fourteen
feet; the third, containing a lodge room and its
a. pendages fourteen feet; and the fourth, coiv
taining a chapter and preparation rooms, eleven
and a half feet, with an archsd ceiling, rising
four and a half feet, and three sky lights.
In tront of each of the second and third stories
are to be four pillars ; the lower Doric, the up
per Ionic, ofbrick, rough cast, wit., stone plinths,
bases and capitals.
The stairs are to be winding, from the ground
door to the top; and under the whole buib ing is
to he a cellar. •
The work must be done in the best manner,
and of the best materials. Lumber can be ob
tained in this city, at ten dollars per thousand,
superficial measure ; and brick, at segen dollars
and fifty cents per thousand.

When the contract is made, good security will
be required for the contractors’ complying with
their proposals; and they will be accommodated
with advances, during the progress of the work,
the fund* being now in hand for the building.
