any slave not owned or hired by him or her, or
(awfully under IfiS or her care.or charge, toen

the lot attached thereto, at any time during the
Sabbath, or between nine o’clock at night and
sun-rise at any other time, without a special tick
et of permission from his or her owner or hirer.

has occupied the attention of the many
thousand men of enterprise who have beheld its
advai tageous and unrivalled location, by recem
acquisition of the Creek territory, in Alabama,
is becoming an object of such great notoriety,
that the proprietors have determined to offer the
game for sale, io Lots of the ordinary size, on

Persons who have visite the most attractive
points, where an interchange of the products of
the interior and of foreign commodiiies take
place, are unanimous in tne declaration, that
this place possesses pre-eminent advantages over
any other in the Southern country. Situated at
the extreme head of navigation on the Coosa a
river navigable to this point by steam boats - f
the largest size, for convenience and health
its location is unsurpassed, presenting to the eve
a perfect unhioken plain, having n declination
sufficient only to convey off the superabundant
water. In front extending to the river, is a bold
Bluff, graduating on its upper and lower extre
mities, into the finest natural landings—on each
side supplied with never failing streams of ex
cellent water —towards the interior, terminating
in gently undulating eminences, offering the
most desirable situations for private residences
But all these considei ations sink into insignifi
cance, compared with the unrivalled advantages
which it possesses for an extensive trade. Ne
cessarily the only depot for the supply of a
wideiy extended up-country with merchandize,

productlons of tive fertile vallies of the Coosa,
the Tallapoosa, an I the Upper Cbattahoochie,

t ve uplands of lalladega, the latter of which,
io all human probability, will be peopled by fc

country of these regions, abounds in quarries of
Marble, Limestone, and in fact all kinds of
mineral wealth. As respects the contemplated
connexion of the waters of the Tennessee with
those of the Alabama ; ifbyaCanal itwil'have
its emhouchement; if by a Rail Road, immedia
tely at this spot will terminate one of its extre
mities. The well known advantages of this
place renders further remarks unnecessary, oth
er than to say that to the capitalist it affords !
desirable opportunity for profitable investment
to the merchant it offers advantages of an ex
tensive trade ; to the mechanic, the allurements
of what must soon become a flourishing town,
not of ephemeral existence, but of a permanent
:<nd daily increasing importance ; to the plan
ter , a desirable and pleasant town residence,
convenient to the alluvial bottoms of the Coosa,
the Alabama and the Tallapoosa. In addition
ro which it will undoubtedly, at no remote pe
riod. become the location of the State Capital,
for which it offers- greater inducement than any
point on the eastern waters of the State.

WHEREAS on the I7»h of October, 1832,
the Board of Directors of this Institu
tion passed an order that au instalment of 25
per cent, on the Capital Stock of this Bank be
paid in, on or before the 18ih of December inst.
and it further instalment of 10 p#r- cent, on or
before Friday tbe2Blh tost betweeiwthe hours
oi 9 and two o’clock; which said order has
been regularly published from the date thereof;
And whereas, on the Ist day of December inat.
the Board of Directors passed another order the
object of which is to revoke so much of the
above stated order as requires the payment of
25 per cent, as thereto stated, against which
said revoking order a minority'of said Directors
entered the following protest:
“The undersigned enter their protest against
the resolution revoking the order for an instal
ment of 25 per cent, on the Capital Stpck of this
Bank, to be paid on or before the I&h of Decem
ber, 1832, for the following reasons
Ag:eeaoly to the above Resolution, the under
signed enter their protest against the resolution
of Mt. Mitchell revoking the order for an instal
ment of 25 per cent on the capital stock of this
Bank, to be. paid on oi before the 18tii Decem
ber 1832, for the following reasons :
Ist. Betuuse the order of the Board of Direc
tors enhinr in said Instalment was passed by a
board consisting of eight members, and with all
the forms required by the charter—a and because
some oi the Stockholders having paid said in
staiment pursuant to public notice, and received
a cerlifiiate for the same, refuse to have them
cancelled—and because there was sufficient time
to have given ihe legal notice required by the
charter calling a meeting of the stockholders to
; ascertain whether a majority of the stockholders
were in fayor or against a payment of said in
stain ent.
21. Because two of thß members voting for
s- id resolution compose a part of a number con
sisting of not more than six persons, who have
purchased up a mnjorit. of the stock of this
Bank for the purpose, as we believe, of eon
tioliiqg its operations, and the said members
. muring declared at this Board their object in
? jure basing said stock was not for an interest of
8 per cent.
■Sd Because they believe it a duty they owe
'to the stockholders as well as to the public—to
’pi event as far as in their power the stock getting
into the hafids of speculators, arid thereby be
come a private institution, and subject to all the
oranges and uncertainties of individual com
mercial establishments, and consequently liable
to become a nuisance to the public, as has re
cently happened to a Bkuk, tinder similar cir
cumstances in the state—all which they conceive
(heir duty to oppose and prevent if possible.

still in full force, and shall insist on a coinpli
ance with the requisitions thereof, or in default
forfeiture of stork will be claimed in behalf of,
