and 1 will put in a claim under the law, and if
found against me, I will return you the proper
ty on the day of sale; and the claimants accor
dingly give the bond and received from the
sheriff the property seized by him. This the
Court decides to be a sufficient consideration in
law, to sustain the contract; and when this
contract shall be properly declared on, it may
be enforced, but as before stated, the suit being
improperly brought, it cannot be sustained in
its present form. The Court being requested
to give its opinion, as to the liability of the
defendants, in consequence of there being no
final verdict subjecting the property under the
statute, the Court decides, that the law having
given the claimants the right, either to proceed
on with their claims to a final verdict, or to
withdraw their claim and thereby admitting the
property to be subject to plaintiff’s claims; it is
equivalent to the finding of this fact by the
Jury, and will make the defendants equally lia- ;
ble on the bond as though a final verdict had
been rendered subjecting the property. The
claimant’s confession being of equal force astp
the fact, as would be the verdict of a Juiy, and ,
by w’hich means he escapes from the damages ■
which may be assesed by the Jury against him.
A non suit is awarded in this case.
