S On the petition of David Douglass, shew ing that John Clarke, did, on the twenty- eighth day of February, one thousand eight hundred and sixteen make his certain writ- ing obligatory, sealed with his seal, and bear ing date on the day and year sforeiaid, wher by he acknowledged himself to be held and folly bound to the said petitioner in the pen* al sum of one thousand and seven dollars and fourteen cents, conditioned for tlie payment of five hundred and three dollars and fifty seven cents, on or before the first day of January then next ensuing, and that the said John Clarke, for the better securing the payment of tbe said sum of money, did mortgage to the said David Douglass aft that tract of land situate in the county of Cam den, on the waters of Crooked river, bound ed on the north by lands of John Wood, es quire, on the northwest by Crooked creek and mtneh land, and on the southwest by lands of Nathaniel Green and on Crooked creejc, which, said trict contains five hun dred acres, more or less; and it being made further to appear that no part of the money in the said bond specified has been paid to the said David Douglass; on motion of Richard W Habersham- attorney foe the |v**t»Seee—, it is ordered, that the said John Clarke do pay into this court within twelve months from this date t-Ve principal interest and costs'due out?* said bond and mortgage— otherwie ‘^equity of redemption in and to the so.;-' tgaged premises will from thenceforth be foreclosed, such further and other proceedings take place as are directed by the act of assembly in such cases made and provided; and, it is further ordered, that this rale be published once * month for twelve months in one of the gazettes of this state, or served on the said John Clarke, nr his agent, at least six months previously to the time appointed for the payment of the money into con t.
