It may be safely asserted, that there is scarcely a case of insolvency where there is not some fraudulent assign ment ; some partial and unjust preference; mid some abominable exclusion of perhaps the most, honest and most needy creditor^ of the insolvent. If the merchant fails, and the firmer comes to the city to look after his effects, he now finds it“ swallowed up by assign ments and judgments, given to more press ing or more favoredfereditiors; ami he must sit down with a toVUoss.
