THE WASHINGTON STATUE
The subject of Ihe Equestrian Statue

SBeniOry of Washington, was yeiterday
«gv - i before the senate. The discussion
•culled in passing the lull to a third-read-
€ng« with a prevt.u, tliat, if the sum of
' 130,000 ilolUrs, therein propria ted,shoe Id
%<-’ found insufictent to accomplish the ob
ject of the bill, -theif the president shall
not j riiceed tocarry it into execution, but
shall cause properestimatesof the expense
ntftuch a work to be laid before congress.
When the subject was under considera
tion ou Wednesday, a motion was made
f 4y Mr Forayth to amend the bill, by strik
ing out the whole of it, excepttlie enacting
clause, and inserting in lieu thereof u pro.
position fur erecting a monument ou the
Spot, at Mount Vemou, where the remains
of the deceased patriot now lie. This mo
tion occasioned some discussion; iu the
course of which, Mi-Pronientin, though
Opposed to the ^jtmtidnient being received
as a substitute to the bill, was willing to
receive it us additional toil, a > that, bt -

erected over the tumb of yVsahingtun, still

Mr. Forxtti;"s motion having been nega

proposition he had suggested by way of
amendment; as a new section to the bill;
which motion, however, was negatived —'

the iiilerestining cause of the state of Ma

H will no tl'iubt be said by y..nr reader^ that
the public is dreil of the Seminole war, and the
investigation of general Jackson’, conduct in the
prosecution cf i<: butt hope t may be -indulged in
a few remarks. which appear to have escaped ‘.lie
atl-.ntioa of congress. notwithstanding 10 much
lime and money have been wasted upon these mb*
jeeta.
One member of congress observed, that general
Jackson ought to hare ordered a eowt ofmqnry.
into the conduct of ArinNbnot and Ambriztcr—
Such an 'itder would ha#e been a direct violation
of the ninety second article of the rules and arti
cles of war. Other members of the same body
contended, that general Jackson had no right
*i/r*v the sentence of the court, in tne
of Ambrister. 1 be general did net alter the
senter.ee of the court: He approved of the
first sentence. Ing disapproved of the list.—
This executive power is vetted in the general or-
lering the court, by the sixty-fifth article of tlie
rates snd articles of war; by which he may approve
or Btepprore of any part, or ef the whole, of any
sentence or sentences pronounced by any mifitary
tribunal; convened by his order. The court by
which Ambrister was tried, re-coneidered cheir first
sentence against the prisoner, after it had been
made a record. This was an exercise of excrun'ue
power, which Vs 'not veateef in say court. in Crim.

upon record, where a military tribunal has exer-
eiardttiis power.
I observe thst a resolution has been offered in
the senate cf the United lutes, requesting the
president to strike from the rolls of the army and
navy, the aarnej cf all such otficers as were di
rectly or indirectly concerned in counselling, aid.
i>'g crabelmg the late duel, between Mason and
M'Carty. The martial law in such cases, is very
severe; and in addition thereto, officer* are amc.
liable to the civil laws cf their country. Surely
tlie senate must have a contemptible opinion of
the president of the United States, if, in the exer
cise of his executive functions, they think he re-
quires their advice to disgrace su officer without
hearing, or the form of a trial. I am sorry to
cc this unconstitutional interference. A.

BILL RELATIVE TO B.LYR>\
.The cominialte to uhmn was refered the bill,
entitled **An act to amend an act, entitl&l “an
act relative lo banks, and tor other purpose?, : ”
passed April 28di, 1818, respectfully report;—
That the Exchange Dunk was established in th?
city ot Ncw-Yotk, in May, 1815; and for nearly
tvur years has commanded the confidence, and
received the approbation of community, as ap
pears by the petitions of a numerous class ofcitl*
5, now before the ffcnate. When »t was >o
eitubiislied, thcr? was no legislative provision,
it tier by iui.M slate, or the United state*. proh»b-
L.ng private b^ .k.ng; on the contrary, it w.is ex-
prc.*-»ly reergt-ized by ret of congress, and left
open to ci'tztfi* of tins state by our own legisla
ture The proprietor of the Exchange Hank,
commencing f.is b;.nk under ?uch circumstance*,
as fairly entitled to the favorable regard and the
liberal protectirn of tiie state, so long as his es
tablishment was conducted with credit and
ability
fr*or this reason, the legislature, at tneir last
session, exempted the Exctiauge Hank, for the
term o* three years, fxom the provisions of the act
passed oy them, prohibiting private banting.—
The act under consideration, proposes to extend
ttiat exemption, until the year 1882, when the
charters of the incorpo:a’ed banks wil! expire;
and your committee car. perceive no got d reason
against snclt extension. No distinction should be
made between those institutions but that arising
frbm real and intrinsic merit. The petitions be
fore the senate, abundantly* *kew, that the Ex
change Dank has been hitherto conducted to the
entire sati>facrion of its dealers.
The coaimiitre Lave examined the bill, and
would recommend its passage, with the addition
of two pr>* vision*; the first, reserving the legisla-
tore the right of hereafter repealing this act, or
of regulating the bark, whenever it may by them
be detmed necessary (or .hr public good; and the
>econd, establishing some prudential regulations
to ensure the prompt redemption of its notes.— ,
Your committee laive amended the bill accord*
