foreclosed from henceforth, and that such fur

U PON petition of the President, Directors and
Company, of the Bank of the United States,
praying the foreclosure of the Equity of redemp
tion of all that lot of land and buildings known by
the number eight Wilmington tything Darby ward
i»* the City of Savannah and state of Georgia, con
taining sixty feet in .'rontaud ninety feet in depth,
mortgaged by Matthew McAllister now deceased,
in his lifetime by deed of mortgage, dated on the
tenth day of March in the year eighteen hundred
and twenty three, to Matthew Hsu McAllister his
heirs and assigns to secure IQ the said Matthew
Hall McAllister, the payment of certain promisso
ry note* made b} the staid Mstther McAllister to
the said Matthew Hall McAllister or order, for
the aum of five thousand dollars, which aaid note
bears even date with the said mortgage and is pay
able at a day now past, and which nui mortgage

ton, lately trading under the firm of lRobert
and John Bolton, stating that they had been pos
•eased of a certain writing obligatory made and
executed by one Joseph Beven, decased, in his
life time and bearing date on the second day of
December,eighteen hundred and fourteen, where
by the said Joseph Beven, acknowledged himself
to be hold and firmly bound to the said Robert
and John Bolton in the penal sum of three thou
sand eight hundred and fifty four dollars, ant*
Tinety tour cents-with a condition thereunder
written for the payment of the sum of nineteen
hundred and twenty seven dollars, and forty se
ven cents, with interests thereon, from th* ninth
day of March 1814, m copy of which bond, as
nearly as the petitioners can recollect is annexed
to the said petition, together with the affidavit of
the said John Bolton to prove the existence of
said bond, and the loss thereof. On motion
Richard W. Haberaham, attorney forth* pe-
doners—It is ordered, that the legal represents
tatives of the aaid Joseph Bevan, deceased, do
shew cause on or before the first day of the next
term of this court, why the pmyer of the peti
tioners should not be granted. And it is further
ordered,that this rule be published in one or more
of the public Gazettes of the city of Savannah,
once a month until the time appointed for shew
ing cause thereon.
