praying the foreclosure of the Eauity of redemp
tion of all that lot oflaiul and buildings known by
the number eight Wilmington tything Darby ward
in the City of Savannah and (state of Georgia, con
taining oixty feet in front and ninety feet in depth,
mortgaged by Matthew McAllister now deceased,
in his lifetime by deed of mortgage, dated on the
tenth day of March in the year eighteen hundred
and twenty three, to Matthew H»dl McAllister his
heirs and assigns to secure to the said Matthew
Hall McAllister, the payment of certain promisso

ton, lately trading under the firm of Roller
«»d John Bolton, stating that they had been pos
sess.’d of a certain writing obligatory mule and
executed by one Joseph Dcvcn, tlwcased, in his
life time and bearing dote on the second day of
December,eighteen hundred ar.d fourteen, where
by the said Joseph Reven, acknowledged himself
to be livid and firmly bound to the said Robert
and John Bolton in tlie penal sura of three thou
sand eight hundred and fifty four dollars, an*'
satiety tour cento— with a condition thereundet
written for the payment of the sum of nineteen
hundred and twenty seven dollars, and forty se
ven cents with interests thereon from tb* ninth
iay of March 1814, a copy of which bond, as
n’.atly ap the petitioners can recollect is annexed
to the said petition, together with the nffidavitof
the said John Bolton to prove the existence ol
said bond, and the loss thereof. On inot-on
Richard W. Habersham, attorney for the pe*
honors— It is ordered, that the legal represent*
tatives of the said toseph Be van, deceased, do
shew cause on or before the first day of the next
Grib ol this court, why the prayer of the peti
tioners should not be granted And it ia further
ordered,that this rule be published in one or more
of the public Gazettes of the city of Savanna!.,
