in his lifetime by deed of mortgage, dated on the

heirs and assigns to secure to the said Matthev
Hall McAllister, the payment of certain promissj

in the said mortgaged premises snail from thence-
forth be foreclosed and such further, and other
i * proceedings take place all are in pursuance of U. i

terest in three promisory notes, dated 10th Feb.
1822, on which there is now due two thousand one
hundred and thirty six, 64*100 and interest there,

On motion of Morrison A Nicoll, attorneys for
the petitioner, Uia ordered that the said sum of
money and interest ao due as aforesaid from the
said George L. Cope to the said Wm. Whitefield,
be paid into court within twelve months—and
unless the same be ao paid the equity of redemp-
tion of the mortgaged premises be thenceforth
foreclosed and other proceedings take place pur
suant to the act of assembly, and further ordered,
that this rule be published In one of ahe Gazettes
of this state, once a month till the time appointed
for payment, or served on the mortgager or his
special agent, at least six months, before said mo

sessed of a certain writing obligatory wade and
executed by one Joseph Beven, deceased, in bis
life time and bearing date on th?, ^?qgnd day of
December,eighteen hundred and fourteen,where
by the said Joseph Beven. acknowledged himself
to be held and firmly bound to the said Robert
und John Button in the penal sum of three tbou
sand eight hundred and fifty four dollars, and-
ninety four centB— v/ith a condition thereunder
written for the payment of the sum of nineteen
hundred and twenty seven dollars, and fdrty seven
cents* with interests thereon from the ninth day
ot March 1814, a copy of which bond} as nearly as
the petitioners can recollect is annexed to the said
petition, together with the affidavit of the said
John Bolton to prove the existence of the said

P * answer to L, H. Bonnel’s piece, which ap
peared in this paper, under date 31st ult —I
have to remark, that his statement is false and er-
roneous, in as much, that I was never asked to sell
out, or make any assignment of property belong,
ing to me—neither was I asked to dissolve our
Connection in partnership, which was to be con
tinued for three years from 3d Oct. 1822, under
bonds— and this Co-partnqrsbip has never been
revoked. The assignment, he alludes to in his
piece, 1 know nothing about. The state of my.
health was such for many weeks before I left
here for the north, to unable me to perform any
transaction in business 1 therefore protest a
gainst L. H. Bonnel having any right to setttle any
account of the firm without my consent.
