the commissioners appointed by the last Legisla
lure to sell the fractional surveys, to expose to

of Waiton, which was within the ninth district

the foreclosure of the Equity of Uedemp
tj.m ol ’the following premises, mortgaged by
William I. Sims and Margaret Sims, on the 3d day
of June, in the year eighteen hundred and twen
ty, to secure, unto the Raid James Roberts, the
payment of a certain promissory note, drawn by
the said Williaim I. Sims on the said third day of
June, the said year, in favour of James Roberts,
or order, for the. ^um of six hundred and thirty
eight dollars, and eight cents, nayuble on the first
day of January in the year eighteen hundte I and
Uenty two,to wit: all that western moiety or
haiflot, of thitlot of land in the city of Savan
nah, in Ogletliorp ward, known and distinguish

praying the foreclosure of the Equity of redemp
tion of all that lot of land and buildings known bv

taining sixty feet, in front and ninety feet in depth,
mortgaged by Matthew McAllister now deceased,
ir*his lifetime by devd of mortgage, dated on the
tenth day of March in the year eighteen hundred
and twenty three, to Matthew Hall McAllister his
hsirs and assigns to secure to the s:tid Matthew
Hall McAllister, the payment of certain promisso-
ry notes made by the said Matthew McAllister to
the said Matthew Hall McAllister or order, for
the sum of five thousand dollars, which said note
bears ev n date with the said mortgage and is pay
able at a day now past, and which said mortgage
and note were afterwards duly assigned, ana in
dorsed by the said Matthew Hall McAllister to
the said petitioners. And the petitioners having
further stated that there is now due and owing
on the said note and mortgage the principal sum
of five thousand dollars with interest from the JOlh
day of May 1823.
On motion of Habersham for thr petitioners, it
is ordered that the principal, interests and costs
due upon the said mortgaged prtl'tthes be paid
into court within twelve months from this date,
or on fuilut e so to do, the Equity of redemption
in the said mortgaged Premises shall from thence
forth be foreclosed and such further and other
proceedings take place as are in pursuance of the
statute in such case made and provided. And it
is further ordaine 1 that this will be published in
one of the public Gazettes of this state at least
once a month for twelve months or a copy thereof
served upon the legal rept esentatives of the said
Matthew McAllister, st least six months-previous
to tbe time at which tbe said money isordeied to
be paid into court.

by the said Joseph Beven acknowledged himself
to be held and firmly bound to the said Hubert
and John Bolton in the penal sulb of three thou
sand eight hundred and fifty four dollars, ana
ninety tour cents—with a condition thereunder
written for the payment of the sum of nineteen
hundred and twenty seven dollars, and forty seven
ccuts, with interests thereon from tbe ninth day
of March 1814, o-copy of which bond, as nearly as
the petitioners can recollect is annexed to the said
petition, together with the affidavit of the saiu
John Bolton to- prove the existence of the said

did in conjunction with one Joseph A. Scott, ex.
ecute a joint bond to 'he s id Susan C in the
penal sum offour thousand dollars conditioned
for the payment of two thousand dollars with in
tereat - trom date, on or before the first day of
March then next, and that for the better securing
the payment thereof, the said Jacob did on the
day and year first aforesaid make his certain in-
denture of mortgage, whereby he mortgaged to
said Susan C all thtit lot of ground known and
designated as Garden lot number thirty nine, No
39, and also, that adjoining half part of another
lot known as lot number forty two, No 42, con-
tsinlng together tight and a half acres more or
less situated to the East of the city of Savanqah
and bounded to the north weBt of Lot No 26, to
the South and East by lands belonging to the es
ta'e of Hampton Lillibridge, and the west by
the public road leading to Skidaway island where
on a brick yard is now established and known by
the name of Fahms brick yard—that there is now
on the said bond or mortgage obligatory the sum
of eighteen hundred duilurs with interest from the
23d day of January, 1823, and praying the fore
closure of the equity of redemption of the said
JacoB and his heirs, executors, administrators and
assigns in A to the saidmovtgaged premises.—On
motion of W. W Gordon, attorney for the peti
tioners—it is ordered that the principal and in-
terest due on tlte said bond or writing obligatory
togeth er with the cost of this application be paid
into this court within twelve months from this date,
or ih ca*e of default tha* the equity o! redemp
tion of said Jacob Fahm, his heirs executors, ad
mlnistrators, and assigns be from thenceforth for
