Sale of Fractions.
a N Pursuance of a joint resolution otthe Gen*
era) Assembly of the state of Georgis, up -
proved the 23d of November, 1823, authorising
the commissioners appointed by the last Legists
ture to sell the fractional surveys, to expose to
sale all the fractional surveys lying in the county
of Walton, which Was whhin the ninth district
formerly Henry county, the commissioners afore
said will offer for sale in the town of Milledgcville,
on Monday the 9th day of February, 1824, the f»L
lowing fractions, viz -
Nos. 373,374, 400,491,402, 403, 404, 423, 424,
425,426,427, 428, snd 429, m the ninth district
of originally Henrv, now Walton county.
The aforesaid fractions t» be sold on the same
terms and conditions as the fractions heretofore
advertised and sold by said commissioners, under
the act of the I .egtaUture of the state passed 23d

O N the petition of Aaron Cleveland and Susan
G. his wife; who was Susan C. Bona, stating
that Jacob Fahm, before the intermarriage of the
petitioners, to wit; on the 22d day of June 1821,
did in conjunction with one Joseph A. 8cott, ex
ecute a joint bond to the said Susan C. in the
penal sum of four thousand dollars conditioned
for the payment of two thousand dollars with in
terest from date, on or before the first day of
Maroh then next, and that for the better securing
the payment thereof, the arid Jacob did on the
day and year first aforesaid make bit certain in
denture of mortgage, whereby he mortgaged to
said Susan C all that lot of ground known and
designated as Garden lot number thirty nine, No
39, and also, that adjoining half part of another
lot known as lot number forty two, No 42, con
taining together eight and a half acres more or
leas situated to the East of the city of Savannah
and bounded to the north west of Lot No 26, to
the 9outh and East by lands belonging lo the es
ta'e of Hampton 'Lillibridge, ana the west by
the public road leading to Skidaway island where
on a brick yard is now established and known by
the name of Fahma brick yard—that there Is now
on the said bond or mortage obligatory the sum
of eighteen hundred dollars with interest flrom the
23d day of January, 1823, snd praying the fore
closure of the equity of redemption of the said
Jacob and his heirs, executors, administrators and
assigns in & lo the saidmortgaged premise*.—On
motion of W. W. Gordon, attorney for the peti

Company, of the Bank of the United States,
praying the foreclosure of the Equi'yof redemp
tion of alt that lot of land and buildings known by
the number eight Wilmington tything Darby ward
in the Vily of Savannah and state of Georgia, con
taining sixty feet in front and ninety feet in depth,
mortgaged by Matthew McAllister now deceased,
in his lifetime by deed of mortgage, dated on the
tenth day of March in the year eighteen hundred
and twenty three, to Matthew Halt McAllister his
heirs and assigns to secure to the said Matthew
Hall McAllister, tbe payment of certain promisso-
ry notes made by the said Matthew McAllister to
the said Matthew Hall McAllister or order, for
the sum of five thousand dollars, which said note
bears even date with the said mortgage and is pay
able at a day now past, and which said mortgage
and note were afterwards duly assigned, and in
dorsed by the said Matthew Hall McAllister to
the '(aid petitioners. And tbe petitioners having
further stated that there is now due and owing
on the said note and mortgage the principal turn
ol five, thousand dollars with interest from the 30th
day of May 1823.
On motion of Habersham for tbe petitioners, it
is ordered that the principal, interests and costs
due upon the said mortgaged premises be paid
into court within twelve months from this date,
or on failure ao to do, the Equity of redemption
in the said mortgaged premises shall from thence
forth be foreclosed ana such further and other
proceedings take-place as are in pursuance of the
statute in such case made and provided. And it
is further ordained that this will be published in
one of the-public Gazettes of this state at least
once a month for twelve months or a copy thereof
served upon the legal representatives of the said
Matthew McAllister, at least six months previous
to the time at which the said money is ordered to
be paid into court.
