for the removal of such nuisances or causes of disease

Whereas the culture of Rice upon the lands around Hi«-
city of Savannah which by contract nro subject to dry
culture, is u violation of the true Intent and meaning «>r
the said contract, and Is prohibited by the ordinniu-i * of
the city, and I* manifestly Injurious to the hoolth oftli*
citizens; and whereas power is vested in the Mayor and
Aldermen of the elty Of Savannah and the hamlets there
of, by Act of the General Assembly, to carry into full effect
the system of dry culture, and to remove nil milsnmT* or
or causes of disease which may cfiect the health or the
citizen*; and whereas, It la the right and 1-n* become tire

red upon them, for the public good.
Section 1. lie It ordained by the Mayor and Aldermen
of the city of Savannah and hamlets thereof, Tirol it

information that Rice Is planted or cultivated upon any
ofthe lands around the city subject to dry culture con
tracts, to serve a notice upon the owner, tenant, or culti
vator of the said land, or any person having the charge of
the same, or bis, her or their agent, requiring the ml I
person to desist from the said culture, and to jfestroy the
said Rice if growing, or to appear before Council nt a time
and place in such notice to be specified, not exceeding
tea days ftom the date thereof, to •how esnso if any they
have, why the said growing Rice should not be removed
snd destroyed as a nuisance.
Sec. 2. And lie it further ordained, That if the said
owner, tenant, cultivator or other person, shnll nor, upon •
tire said notice, comply with the terms of tire same, or
shall fell to appear before Coundl, or if having apjwarrd,
no sufllrient cause should be shown why the said Rice
should not be removed, snd IU culture abandoned, thatiu
such case the said Mayorand Aldermen may direct the
City filarebai forthwith to remove the said Blew and to
destroy the same effectually, wherever It may ho planted
or grow ing ou tire said dry culture con trait
Sec. 3. Andb* It further drdained, That the expenses
